Bidders Acknowledgment & Terms of the Auction Sale: 1. Onsite bidders: Please maintain possession of your bidder number at all times. We will be open for bidder registration at the auction office on Friday, March 9, 2009, from 9:00 a.m. until 5:00 p.m. and also the day of the auction, Saturday, March 10, 2009, from 9:00 a.m. until the completion of the auction. 2. On-line bidders through Proxibid are required to send a wire transfer deposit of $2,000 at least 24 hours prior to the start of the auction to secure a bidder number. At the conclusion of the auction, the deposit will either be credited towards any purchases made or wire transferred back to the owner within five (5) business days if no purchases were made. Please contact Bator International, Inc. at (805) 646-9566 or batorintl@aol.com for further information and assistance with off-site bidding. 3.All items become the sole responsibility of the buyer (bidder) when the auctioneer announces "Sold". Bator Auctions is not responsible for damage or theft to sold items once the successful bidder has been announced. 4. Bidders are responsible to know what they are bidding on. At the time of the sale, we will describe the item as honestly as possible. We receive much of our information from the seller and will also disclose any discrepancies that we see, however, this must not be interpreted as any form of warranty or guarantee as to the age, condition or authenticity. There is no buyer's remorse or cooling down period and absolutely no returning of any item for any reason whatsoever. Winning a bid at auction constitutes a legal and binding contract in which you are legally bound to pay for all items for which you are the recorded buyer of and for which the auctioneer announces as having been sold to you. Should you default upon your purchase (s) in any manner whatsoever (NSF, stop payment order, non payment, etc.), all bidder deposits left with Bator International, Inc. will be forfeited, and you agree to pay Bator International, Inc. the full sum equal to the purchase price, buyer's fee and any additional costs involved in any legal action, transportation, storage and resale of items not paid for. The sum due and payable without relief. 5. In the case of a tie bid or if the auctioneer feels that he missed a legitimate bid, the auctioneer may, at his discretion, put the item back up between the two bidders. 6. A 13% internet buyer's fee on the hammer price will be charged for each item purchased. The minimum buyer's fee per item is $200. 7. All purchases must be paid for in full at the end of the auction unless other arrangements are made with Bator International, Inc. All sales are final. All items are sold AS IS WHERE IS. All auction items must be removed from the auction facility no later than 3:00 p.m. on Sunday, October 11, 2009. Any items left at the facility after that time will be moved to a storage facility and the owner will be charged for all fees incurred by Bator International, Inc. including but not limited to transportation and storage of said items. 8. Acceptable methods of payment are cash, bank wire transfers, cashiers checks, travelers checks, personal or company checks (backed by a current dated bank letter of guarantee for the amount of the check written) or personal Mastercard and Visa cards. Payment with American Express, company credit card or any Rewards credit card is acceptable with an additional 3% convenience fee per transaction. Bank title drafts are not acceptable. Please note that bank letters of guarantee must be received at the auction office at least 24 hours prior to the start of the auction for verification. If the vehicle is sold on a "Bill of Sale Only", buyer accepts all responsibility and cost in obtaining a title and/or registration and paying all applicable taxes in their particular state or country. 10. Licensed motor vehicle dealers must supply copies of state dealer�s license and sales tax certificate. 11. Shipping is available throughout the United States with the Federal Companies (800) 747-4100 (Jackie or Jennifer). Please either check with the auction office for more details or stop by the Federal booth located outside the auction office. PLEASE NOTE: If you will be participating via phone or Proxibid, please contact Bator International, Inc. at (805) 646-9566 as you will be required to furnish a $2,000 bank wire transfer deposit at least 24 hours prior to the start of the auction. If you will be paying for your purchases with a company or personal check, a bank letter of guarantee is also required 24 hours prior to the start of the auction for verification. No bidder numbers will be issued until all requirements are met. Again, the auction office will be open for bidder registration on Friday, March 9, 2009, from 9:00 a.m. until 5:00 p.m. and also the day of the auction, Saturday, March 10, 2009, from 9:00 a.m. until the completion of the auction. This auction is being held in conjunction with the Barber Vintage Motorsports Museum Festival weekend. Any and all fees charged by the Museum pertaining to the Vintage Festival will be extra over and above the fees charged to participate at the Bator International Auction on Saturday, October 10, 2009.
