Special Terms
Internet bidders will need to register with the auction company 2 or more days prior to the auction event. Wiggins Auctioneers require a bank letter of guarantee and the contact information for the registering bidders financial institution. Bank Letter of Guarantee can be faxed to Wiggins Auctioneers, LLC at 580-237-4915.
Specific requirements can be waived for individuals that are already established customers with Wiggins Auctioneers L.L.C., by contacting the auction company. Neither the auction company nor the seller(s) are responsible for loss of internet signal.
A 10% down payment will be required from any winning bidder, immediately following the auction event. These funds shall be wire transferred to Wiggins Auctioneers Trust Account at the Central National Bank and Trust Company in Enid, OK. Specific routing numbers and details will be given to the winning bidder immediately following the auction event. A 1% buyers premium will be added to the high bid to establish the total purchase price. Buyer shall provide the balance of the full purchase price and Seller shall provide merchantable title to the Buyer at the time of closing, within approximately 30 days, according to the Terms and Conditions of the purchase contract.

• Personal Property: Any personal property, including but not limited to any livestock, livestock equipment, panels, hay, electric fencing, or farm equipment, is the property of the Seller or Former Tenant and may be removed prior to the time of possession.

This land is currently does not appear to be enrolled in any F.S.A. programs.
• Minerals: No minerals are being sold or transferred with the surface and the abstracts shall exclude the mineral documents.
• Taxes: The 2010 ad valorem taxes were approx. as follows and have been paid by the Seller:

The 2011 taxes will be prorated to closing.
• Possession of cropland (Tract #1, Parcels #4 & #5): Possession of the cropland will be given upon signing the purchase contract and acceptance of the escrow deposit for the purpose of tilling the soil as is necessary for conserving moisture and for preparing for and for planting a wheat or rye crop. If for any reason this agreement does not close, the Seller shall pay the Buyer the average reported rate as published by the O.S.U. Extension Service for any tilling or planting which Buyer may have done, and Buyer shall immediately relinquish possession to Seller and neither party shall be liable to the other for any further damages.
Possession of grass and timber: Upon payment in full of the purchase price and transfer of title.
• Terms: A 10% down payment will be required at the auction. You may use a personal check. Buyer agrees to purchase title as shown in the attached title insurance commitment, and shall have ten days from the delivery of title insurance commitment to seek legal counsel to review the title insurance commitment if desired, and to furnish additional title objections, if any. Title will transfer by Warranty Deed. Seller will make available to Buyer and Buyer may purchase an owner’s title insurance policy at closing. Seller shall pay the cost for the initial abstracting, Seller’s title opinion, Commitment for title insurance, gap check and title curative cost, if any. Buyer shall pay any applicable Buyer’s title opinion or attorney’s fees; title insurance premium and final abstracting costs.
• Closing: Closing is to be on or by October 17, 2011, in accordance with the attached real estate purchase contract. The Closing Agent is Lala Young of Fairview Abstract Company. Her phone number is 580-227-4524. The closing/escrow fee is $300.00 per tract or parcel and is to be paid ½ by the Buyer and ½ by the Seller. Closing is to be at the offices of Fairview Abstract Company, 116 E. Broadway, Fairview, OK 73737, unless parties agree to another place of closing.
• Survey: Seller is not obligated to furnish Buyer a survey of the subject properties; if Buyer desires a survey, it shall be at Buyer’s sole cost.
• Order of Auction & Explanation of the Multi-Par Bidding System:
(Tract #1): Will be offered in 5 parcels & in its entirety.
(Tract #2): Will be offered in 2 parcels & in its entirety.
1) The land will be offered in individual tracts and in combinations of tracts in a multi-parcel auction format.
• This is the fairest way to sell property because everyone will have the opportunity to bid on the parcel or combination of parcels they want and may increase their bids all the way to the end of the auction.
• The system will show which bidders are in a winning position throughout the auction.
• Bidders will have the opportunity to bid on individual parcels or combinations of parcels at any time before the auction ends.
• Bidders who want to buy a collection of parcels that must remain together, such as contiguous parcels, should not bid on those parcels separately; rather, you should create and bid on them as a combination. Bidding on them separately may cause you to be left with outlying parcels while losing other parcels to other bidders.
• All parcels and combinations of parcels may be bid on by any bidder in the room at any time prior to the end of the auction.
• Nobody will know who has won and who has lost until the auction is over because additional bids will be accepted on all parcels and combinations of parcels until the auction ends. Therefore, just because your parcel or combination of parcels, are not currently in a winning position, please do not leave the auction until it is over. An incoming bid late in the auction may bring you back into a winning position.
2) During the first round of bidding, the land will be offered by the acre with high bidders having their choice of tracts. Following that, the bidding will be by the tract or combination of tracts.
3) Because it can not be determined who the final high bidders will be until such time as the bidding is closed, anyone who is or was a high bidder on any tract at any time during the auction is required to remain at the auction until the bidding is closed.
Note: The auction company expressly reserves the right to re-open the bidding on each property until such time as all bidding has ceased.
