Special Terms
All announcements and updates made by the auction company on the web site shall take precedence over any previously written material or oral statements made. The information contained in the agreement is subject to verification by all parties relying on it, no guarantee, expressed or implied is given. No liability for its accuracy, error or omissions is assumed by the owners or the agents. The property will be sold "as-is". Fahey & Associates Inc. is representing the Seller in this transaction. Dual agency may apply. Any Buyer who wishes to be represented by another real estate company may do so, in that case, any compensation paid to another real estate company will be solely at the buyer's expense. The information given is believed to be true and correct to the best of the owner's knowledge. There are no guarantees expressed or implied.
TITLE: The property will be sold free and clear from any and all liens and encumberances, but subject to any easements, restrictions, zoning, environmental, or other municipal, federal, and state laws, right of way, or other matters of record. The Seller will provide the buyer with a copy of any owner's title insurance policy for the property, if in the Seller's possession or control, to Buyer or Buyer's designated title service provider, and Buyer shall obtain the title services determined necessary or desirable by the Buyer or Buyer's lender, including but not limited to title searches, title examinations, abstracting, a title insurance commitment or an attorney's title opinion at Buyer's selection and cost and provide a copy to the seller.
TAXES: The real estate taxes due and payable in the year 2012 will be the responsibility of the Seller. Property PID# 11.0190210
All property is sold “AS IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Fahey & Associates Inc. may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Fahey & Associates Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.
Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Fahey & Associates Inc. shall endeavor to describe in detail each item and any pertinent information about it. Fahey & Associates Inc. will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.
Fahey & Associates Inc. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Fahey & Associates Inc. or anyone else if the Internet service fails to work correctly before or during the live auction. Fahey & Associates Inc. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Fahey & Associates Inc. reserves the right to withdraw or re-catalog items in this auction.
