ServCorp International, Inc. is providing Internet online bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against ServCorp International, Inc or anyone else if the Internet service fails to work correctly before or during the auction. ServCorp International, Inc. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. ServCorp International, Inc. reserves the right to withdraw or re-catalog items in this auction. The auctioneer shall advance the bidding at his own discretion & in bid increments that is in best interest of auction. Auctioneer shall be final judge of any bidding dispute & shall so name a final bidder. The AUCTION records of the auction made by ServCorp International, Inc. shall be binding & conclusive to all parties. When the auctioneer says 'sold' Bidder assumes full responsibility for the merchandise purchased. Should an article be offered with reserve, the item will be listed as Subject To Reserve and confirmation from seller will need to be given before the item can be officially sold. This sale will be conducted by ServCorp International, Inc. (hereafter referred to as "Auctioneer" or "Auctioneers"). The auction is open to public, but all persons wishing to participate by bidding on any of the items must register for the auction and obtain a bid card number. By registering to bid, or by placing a bid, you agree to be bound by all of the following terms and conditions and any other announced terms and conditions of the auction in print & made by the Auctioneer at the auction on auction day: 1. This catalog is furnished as a guide only. All information contained herein is true and correct to the best of our knowledge, but is in no way guaranteed as to the accuracy of description made. Auctioneer and seller make no representation or warranty, expressed or implied, on the items for sale and do further state the items are to be sold "AS IS, WHERE IS" WITH NO WARRANTY OR GUARANTEE. The buyer acknowledges that he is relying solely on his or her inspection, and accepts all responsibility for examining any item offered for sale. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. In no event shall the Auctioneer be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the preview understand and acknowledge that they may not be able to inspect the property as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. ServCorp International, Inc. shall endeavor to describe the property in detail and any pertinent information about it. Auctioneers are representing the Sellers interests in this transaction. Announcements made at the auction take precedence over any printed material or prior representations. Auctioneers will not be responsible for any errors or omissions in the description of the merchandise. 2. ALL SALES FINAL. NO REFUNDS. Bidder agrees that everything is sold 'as is' and that they may not return any item they purchase for any reason. 3. Any Bidder/Buyer who purchases an item agrees to pay, in addition to the sales price, a 13% Buyers Premium (per item purchased), which will be added to the sales price before taxes. Any items requiring a title/bill of sale, will have an additional $25 notary fee added to the item. 4. Buyer must pay for each item upon which his bid is accepted by the Auctioneer's declaration to the sale clerk. 5. All items purchased must be paid for in full by Tuesday, December 16th by 4PM Central time. Cash, cashier's checks, certified checks, bank wire and money orders will be accepted. Business or Personal checks will be accepted only with a Bank Letter of Guarantee. All checks are made payable to ServCorp International, Inc. If you are the high bidder, an Invoice will be emailed within a few hours after the auction has been completed. If payment is by wire transfer the purchaser must pay all fees charged by their banking institution for this service. The amount sent to the auction company for payment must equal the amount due on the invoice. If the net amount received by the auction company does not equal the amount due on the invoice then items will not be released until paid in full. 6. Buyer's Responsibilities: Buyer assumes full responsibility for all items purchased when the auctioneer declares it sold. Any winning bidder that does not pay for and claim item will not be allowed to register at future auctions and furthermore, items that are paid for but not removed will also cause same consequence for buyer. Auctioneer is not responsible for security of items purchased, which include lost, stolen or damaged items. Items left on the premises are at his or her own risk. 7. All purchases required to be taxed are subject to Louisiana and Orleans Parish sales tax unless you have a sales tax exemption. A sales tax certificate must be provided by auction day; failure to provide a certificate will require the payment of sales tax on all purchases. 8. A $25 notary fee will be charged on all title / bill of sale items. 9. No removal of items on auction day until an Orleans Levee Board representative deems it is safe to begin remoal. Online Buyer's will have until Dec 23rd by appointment only between the hours of 8AM and 3PM Central Time, not including Fridays or weekends, for removal of their purchases from date of auction. Loading is the buyer's responsibility. Failure to remove within allotted time will result in forfeiture of items purchased along with any payment received by auctioneer for said merchandise; items will be considered abandoned. If additional time is needed buyer needs to contact Auction Company immediately to make additional arrangements. Bidder/Buyer agrees that Auctioneer has no liability for loss or damage to items left for any period of time at the premises of the Auction. As merchandise becomes the full responsibility of any Bidder/Buyer who purchases merchandise at time of the acceptance or the bid, the Bidder/Buyer assumes all risk of loss and damage to property from that point forward, including, but not limited to, the time that the merchandise remains on the premises of the Auction Site. Buyer is responsible for all shipping, logistics and cost. No equipment may be removed until paid in full. Loading is the responsibility of the buyer. Orleans levee board with assist with certain items on a first come first serve basis, but buyer needs to be prepared to load their own auction purchases in the event that the Levee board personnel is unavailable. 10. The buyer hereby assumes and does agree to indemnify and hold harmless the auctioneer and sellers from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have occurred during the auction or that may have been caused by or during removal or use of items purchased. Neither auctioneer nor Seller assumes responsibility for any accidents or loss due to theft, fire, vandalism, or personal injury. PLEASE NOTE: All items in the auction are 'as is, where is', no warranty expressed or implied. ALL PALLETS are the property of the Orleans Levee Board and will not be sold as part of the lots. By registering for and bidding at this auction, I am stating that I have read and understand the above statements. When I am awarded the bid and declared the Buyer by the Auctioneer, I agree to purchase the property on the day of the sale. ALL SALES ARE FINAL.
