Nonpayers will be liable for damages caused to the consignor including re-marketing costs, rents required to store unpaid items and all costs associated with nonpayment listed or otherwise. Winning Bidders Are responsible for the removal of all purchased Items. Removal must be completed within the time frames listed in the sale description. Please make appropriate arrangements, including trucking and personnel. Auction company does not load or provide labor to load. Should items not be picked up within the associated time frames buyers will be reported for non-performance and lose their to right to bid at any further Proxy Bid auctions. By registering to take part in the auction, Bidder agrees to be legally bound by the Terms and Conditions of Sale and affirms that the bidder has read and comprehended all the terms below. ----------- AUCTION TERMS - PERSONAL & PROPERTY RISK ----------- To bid an item up for auction, potential bidders will be required to register. A buyer’s premium of 20% will be applicable to all purchases at this auction. ----------- Persons attending preview, sale or removal of goods assume all risks of damage or loss to person and property and specifically release the Auctioneer and Auction Company from any claims arising from attendance of said auction. ----------- All property is sold 'AS IS', and ALL SALES ARE FINAL. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. CHECKOUT PICKUP/REMOVAL

PICKUP/REMOVAL: ----------- Checkout days and times will be listed on the invoice or stated that appointments are required. CHECKOUT DATES ARE USUALLY 2 DAYS AFTER THE AUCTION - DATES VARY DEPENIDNG ON WEEKENDS, HOLIDAYS AND ALLOTED TIME BY BUILDING/OWNER. Checkout days and times can change due to unforeseen circumstances (extreme weather, landlord/owner issues, etc.) If checkout dates are changed all bidders will be contacted at the phone number listed on their Invoice. ----------- Buyer/Bidder is fully responsible for physically handling their winning bids and removing from the auction location / property in the allotted time for checkout. ----------- Buyer/Bidder is fully responsible for all phases and aspects of any items requiring disassembly and removal, including electrical and water disconnection, capping electrical wires, and water lines to avoid any damage to the building/auction location. Please be sure to bring the manpower, necessary tools, ladders, moving blankets, bubble wrap, etc. ----------- The auction company does not provide tools, does not provide loading assistance or labor. ----------- The buyer/bidder is responsible for ANY and ALL DAMAGES to all real/personal property that is damaged as the result of the removal of their item, including if the damage was done by their mover/shipper. The buyer is responsible to restore/repair any and all damages. ----------- Please be sure to use the proper equipment and tools and hire a professional for disassembly. ----------- Failure to remove merchandise within the time specified will result in a forfeiture of all monies received. Such forfeiture(s) shall constitute a breach of contract and all purchasers shall remain liable and at risk for any loss, expense, and damages arising from said defaults. MOVING AND SHIPPING

MOVING and SHIPPING: -------- The Auction Company does NOT provide any moving or shipping services. ----------- The Auction company may provide names of local third-party movers in the area but does not assume any responsibility or guarantee of their services. The auction does not make any commissions/referral fee on the recommendations of movers. It is the buyer’s/bidder’s responsibility to verify and decide on the mover/shipper. ----------- The cost of shipping and packing is the sole responsibility of the buyer/bidder. If the bidder for whatever reason, refuses to pay for shipping/packing costs (for whatever reason) the bidder is still responsible for payment of the item. ----------- IF THE BIDDER DOES NOT WANT TO PAY FOR MOVING OR SHIPPING CHARGES (FOR WHATEVER REASON) - THE BIDDER IS STILL RESPOSNIBLE FOR PAYMENT OF THE ITEMS WON THROUGH PROXIBID. ----------- THERE WILL BE NO REFUND DUE TO SHIPPING OR MOVING CHARGES BEING MORE THAN THE BIDDER WANTED TO PAY. PLEASE BID ACCORINGLY. ----------- Large Items – The Auction company may provide the name of a third-party packer/mover to palletize items for freight pickup. The cost to palletize the items will vary depending on the item. The fee will be paid directly to the third-party packer/mover. Items must be paid in full before item is palletized. The freight company must pick up within the allotted time frame for removal. Please contact freight company immediately to ensure there is enough time for pickup. The auction company is not responsible for delayed pickups by freight carrier. Auction locations are only available on the checkout dates listed and cannot be extended as the Auction Company does not own or lease the space the items are located. ----------- PALLETIZING IS AN ADDITIONAL FEE - CHARGES USUALLY START AT $125 PER PALLET - PLEASE VERIFY PRIOR TO BIDDING. ----------- Small items – The Auction company uses a local UPS Store for packing and shipping of small items. Depending on the size and quantities of the items an Auction company staff member may bring the item to the local UPS Store or the local UPS Store may come to pickup the item(s) from the auction location. The item(s) must be paid in full before the UPS Store can take the item. The bidder will pay the UPS Store directly for any packing and shipping charges. The Bidder must let the Auction Company know upon bidding in the auction that they would like to have the item shipped with the UPS Store. All INVOICES MUST BE PAID IN FULL within 24-48 hours of the sale ending and prior to the removal of merchandise. ----------- NO ITEMS WILL BE ALLOWED TO BE REMOVED, PICKED UP, PALLETIZED, OR SHIPPED WITHOUT PAYMENT IN FULL. ----------- Invoices can be paid onsite with CASH, Visa, Mastercard, Discover or before arriving to pickup location through PROXIBID's payment service ATG (clicking the PAY NOW button.) ----------- The winning bidder's FULL INVOICE PRICE must be paid in FULL by the winning bidder, prior to any items being allowed to be removed. ----------- If the winning bidder does not respond to phone calls or text messages by the checkout staff on the first day of checkout, the credit card on file will be charged at the end of the first day. Please remember it is the bidder's responsibility to pickup their items in the allotted time or the items are considered abandoned and forfeited.
