Payment
There is a 4% for online Bidders plus the buyer's winning bid price will than equal the total purchase price offered. All financing arrangement must be made prior to the end of bidding. Winning bidder is contractually bound and will enter into a Contract to Purchase immediately upon being declared the successful bidder by the auctioneer. Upon the close of the auction the winning bidder will be forwarded via e-mail a Contract to Purchase. A signed copy of the contract must be received by United Country Real Estate and Auction services, LLC by the end of the following business day by 5:00 PM, (Eastern). Contract to Purchase may be hand delivered, faxed, or scanned and e-mailed. Seller has the right to accept, counter or reject any offers. Advertised deposit in Special Terms as earnest money will be due upon acceptance of Sales Contract and needs to be wired to Broker's Trust account. Wire instructions can be obtained by contacting the Auctioneer at (740) 965-1208. In the event the buyer refuses to sign the Contract to Purchase and tender the earnest money deposit, the auctioneer may resell the property. The original buyer shall be responsible for any damages and expenses for resale and collection, including reasonable attorney’s fees. The only condition under which the earnest money shall be refunded is if the seller fails to comply or accept the bid or is unable to deliver clear title. If buyer refuses for any reason to close, the earnest money and prepaid fees will be forfeited. All earnest money, less incurred expenses, will be given to the seller. Pursuant to the pre-auction sale bills and applicable law, THESE TERMS AND CONDITIONS REPLACE AND SUPERSEDE
ALL PRIOR TERMS AND CONDITIONS OF ANY NATURE, WHETHER WRITTEN, VERBAL, OR OTHERWISE. IT IS THE
BIDDER’S RESPONSIBILITY TO BE FAMILIAR WITH THESE TERMS AND CONDITIONS. By registering for this auction and
placing a bid, bidder acknowledges that these terms and conditions have been disclosed to bidder, and bidder agrees to
be bound by these terms and conditions. Sale is subject to confirmation by the owner.
1. Buyer to pay a Ten Thousand ($10,000) Dollars per tract or Twenty Thousand (20,000) for the whole NONREFUNDABLE earnest money
deposit upon execution of the purchase agreement, to be applied on the purchase price at closing, or retained by Seller if the closing does not
occur. Earnest money deposit will be held by Technetitle Agency Inc of Hillsboro, OH. Balance of purchase price is due in cash at closing
which shall occur on or before June 1, 2015. Real estate taxes shall be prorated to the day of closing based upon the most recent available tax
rate and valuation. Seller will pay for conveyance fee, closing fee not to exceed $150.00, and deed preparation. Title insurance is available to
perspective Buyer at Buyer’s expense. Closing shall take place at Technetitle Agency Inc. of Hillsboro, OH. Seller will pay no other closing
costs. Seller will not pay any CAUV recoupment. Possession shall occur at the time of closing.
2. All real property is selling in its present “AS IS” condition with no warranties expressed or implied by Seller or Seller’s agent. No
representations have been made by Seller or Seller’s agent with regard to fitness of the real property for any particular Buyer’s development
plans. It is Buyer’s responsibility to have any inspection Buyer desires completed prior to auction. It is the Buyer’s responsibility to pay for
and obtain any and all due diligence inspections and inquiries as to feasibility of Buyer’s intended development plans prior to bidding.
Prospective Buyers are advised that due to the large area of land, all inspections are conducted at Buyer’s sole risk. Please take due care while
exploring the property during open houses or inspections. Buyer shall be responsible for any and all damage caused by Buyer to the real
property, crops or personal property.
3. United Country Real Estate and Auction Services, LLC and all agents associated, represent only the Seller in this transaction. Successful
Buyers shall sign an agency disclosure form acknowledging that United Country Real Estate and Auction Services, LLC and its associated
agents are working on behalf of the Seller.
4. All prospective Buyers who desire to participate in the auction must register the day of sale and prior to bidding on property, and must then
provide such personal information as requested by the auctioneer.
5. Seller has specifically reserved the right to have the auctioneer determine the minimum bid advancement that will be accepted from all bidders,
including the amount necessary to “break” winning bids during the multi parcel portion of the auction. This is not an absolute auction and sale
is subject to confirmation by the owner.
6. The auctioneers will handle any disputes at the time of the auction and all decisions will be final.
7. The property will be sold via a multi parcel auction with open bidding on any single tract or combination of tracts at any time up to and until the
conclusion of the auction as determined by the auctioneer or the Seller. All bids are considered offers to purchase. All bids are therefore held
under consideration until the completion of the auction, as determined in the sole discretion of Seller and auctioneer, and no bidder should
leave the auction until the gavel falls.
8. Each successful bidder will be required to immediately execute the posted purchase contract, and deposit the earnest money described
hereinabove. Earnest money deposit will be held by Technetitle Agency Inc. of Hillsboro, OH.
9. Please view the posted title work for any questions on easements, rights of way, leases etc.
10. Property is being offered in the following manner:
