BUYER REGISTRATION AGREEMENT This sale will be conducted by Brown?s Auction Company (hereafter referred to as ?Auctioneer?). The auction is open to public, but all persons wishing to participate by bidding on any of the items must register with the cashier, sign the Registration Agreement and obtain a bid card number. By signing this agreement, bidder is in agreement with and bound by the Terms and Conditions. 1. A $50 cash only registration deposit will be collected, on behalf of the City of New Orleans, in exchange for a bidder card bearing my bidder number. Said deposit will be applied to any and all purchases made at this auction. If no items are declared sold to my bidder card number, the deposit will be refunded, except in the event of failure to comply with terms listed herein; 2. A nonrefundable $20 notary fee will be applied to the purchase of each vehicle and will be collected at the time of invoice; 3. A nonrefundable $30 documentation fee will be applied to the purchase of each vehicle in exchange for a ?Permit to Sell? issued by the Office of Motor Vehicles in accordance with LA R.S. 32:1711-1732. Said fee will be collected at the time of invoice; 4. ALL VEHICLES ARE SOLD ?AS IS, WHERE IS? & WITHOUT KEYS. THE RUNNING CONDITION OF THESE VEHICLES IS UNKNOWN; 5. ALL SALES ARE FINAL. NO REFUNDS; 6. All items declared as ?SOLD? by the auctioneer must be paid for in full on the day of the auction. NO EXCEPTION; 7. Payments shall only be made by cash, cashier?s check, certified check, money order, and credit cards with a 5% handling fee on credit cards. Purchases made through internet bidding (available through Proxibid) will be accepted by credit card only. The 5% Credit Card handling fee will not be collected for internet bidders. 8. 8% internet buyer?s premium will be added to all purchases bought online. 9. NO CHECKS WILL BE ACCEPTED. NO EXCEPTION; 10. Removal of items will be announced by auctioneer. 11. Items left unclaimed, INCLUDING PAID ITEMS, will result in the declared bidder of said item being prohibited from registering and bidding at any and all future auctions conducted by Brown?s Auction Company, LLC; 12. The buyer hereby assumes and does agree to indemnify and hold harmless the auctioneer and sellers from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have occurred during the auction or that may have been caused by or during removal or use of items purchased. Neither auctioneer nor Seller assumes responsibility for any accidents or loss due to theft, fire, vandalism, or personal injury.
