Terms Of Sale

All property is sold “AS IS”, and ALL SALES ARE FINAL (except for items, which arrive to us damaged or with manufacturers defects). It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Jewelry Auctions, Inc.) may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall (Jewelry Auctions, Inc.) be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Internet Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Jewelry Auctions, Inc.) shall endeavor to describe in detail each item and any pertinent information about it. (Jewelry Auctions, Inc.) will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. (Jewelry Auctions, Inc.) is providing Internet pre-auction and live bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Jewelry Auctions, Inc.) or anyone else if the Internet service fails to work correctly before or during the live auction. (Jewelry Auctions, Inc.) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. (Jewelry Auctions, Inc.) reserves the right to withdraw or re-catalog items in this auction. How does this auction work? Bidders may place pre-bids up and until an item comes up for auction. A pre-bid may be deemed a winning bid, as a large percentage of the lots offered may have been assigned an "ask price" which is acceptable to seller. If a pre-bid does not reach the reserve (if applicable) the house will NOT place bids to protect the reserve. In this case, the lot will be passed (not opened) as the reserve (which may be the initial "ask price") has not been met. Why don't lots open at a dollar? It is unreasonable (in most cases) to assume an item can be won for $1 and therefore, (in most cases) the "ask price" is set at near or at what the seller is willing to accept for the item, however, the $1 Dollar bid increment is honored at all times. Lots, which are sold during the auction will display the word "sold" within the bidder panel. Lots, which are passed will display the word "passed" in green within the bidder panel. Lots, which do not display the words "passed" or "sold" may be brought back up to auction at any time during the event. Bidders may place pre-bids on lots, which have not been sold. In this instance, the catalog will be reviewed continuously throughout the event and lots with NEWLY placed pre-bids may brought up to auction, providing the initial "ask price" and/or reserve (if applicable) is met. As new bidders enter the auction throughout the event (at various times throughout the day and evening) the auction may be extended beyond its original end time. In other words, the entire catalog and/or sections of catalog may be re-started at any time during the event. This process ensures that lots, with newly placed pre-bids, make it to the auction block. Bidders may request that a lot be opened by using their Personal Messaging system via their Bidder Panel. Please PM only the lot number and not the title or description of the lot. Offers may also be made through the Personal Messaging system as well. If an offer is acceptable, the initial "ask price" may be lowered to the offered amount. An offer, which is acceptable to the seller, does not always guarantee a "win" as the offer is still subject to being opposed by other bidders when the item is brought up to auction. How do you know you've won an item? If you can not attend the online auction and you've placed a pre-bid, which is acceptable to the seller, you may win the item if no other bidders bid against you. When a lot is opened, the maximum pre-bid is recorded and at all times, the bidding increment is set at $1.00. If no other bidders oppose the initial "ask price" and the reserve (if applicable) is reached, you may win the item. If you win an item, you will be notified via email and an invoice will be forwarded to you. The credit card you have placed on file will be charged the total amount due. If you prefer to use a different credit card than the one you registered with initially, please, contact us at 888-342-2437 the day after the auction to provide updated payment information. In the event that an item is damaged, Jewelry Auctions reserves the right to credit the buyer the hammer price of the item plus, the Buyer's Premium. In the event an item is not received by the seller, JewelryAuctions will tender a full refund and the applicable Buyer's Premium. In some cases, items may be shipped directly to the buyer by the seller/owner of the item. In the event an item is NOT received by the buyer, Jewelry Auctions will credit the buyer for the hammer price of the item plus, the applicable Buyer's Premium. This auction is operated by Jewelry Auctions, Inc. a New Jersey corporation. Items may be shipped to the winning bidder directly by the seller who may be located in a State other than New Jersey.
