2012 Bay and White ApHC Mare. Sired by DZ WEEDO and out of CHIPS SMOOTH MOVER, ApHC, by HOT CHOCOLATE CHIP. her sire, DZ WEEDO is an All Around Sire who began his show career by winning the prestigious ApPHA Western Pleasure Futurity as a Two Year Old under the direction of Baker Training Stable. "Odie", as he was affectionately known, later went on to win the Jr Trail and the Jr Western Riding at the ApHC World/National Championship Shows. Char-O-Lot Ranch purchased him then as a potential sire for Western Pleasure and All Around horses, and he went on to prove himself in that area. DZ WEEDO was nominated to be a Breyer Model Horse, and his model was completely sold out in a relatively short time span. "Odie" has sired 254 registered foals. Of those foals, 11 are Bronze Medallion Winners. His specialty was in producing Western type horses that could do all events, and many of them to this day, are winning across the nation, with Youth and NonPro exhibitors. His foals have earned 2,415 Performance Points and 602.5 Halter Points. He has sired Multiple Youth and NonPro World and National Champions, including 4 Superior Event Horses, 3 ApHC Club Champions, 3 ApHC Versatility Champions and 2 Supreme Champions. The Dam of DANCIN IN THE WEEDS, CHIPS SMOOTH MOVER, was shown as a Yearling in Longe Line, placing well. She was injured as a two year old and retired to the broodmare band at Char-O-Lot Ranch. She is an own daughter of the famous HOT CHOCOLATE CHIP - ApHC. This fancy mare, DANCIN IN THE WEEDS, is pretty colored, easy to manage, and easy keeper, and an easy breeder. CONDITIONS OF ONLINE PARTICIPATION 1. BIDDER REGISTRATION: A. You must be registered and pre-qualified to bid through our online bidding service provider for this sale as listed on our website www.alanparkerauctions.com, and in the sale catalog. During this registration process, you will be asked to provide complete personal information, including telephone, email, credit card information and banking information. ALL INFORMATION MUST BE COMPLETED IN FULL TO PARTICIPATE IN ONLINE BIDDING. B. For anticipated purchases of over $15,000, or for more than your credit card limit, you must contact us by or before 11:00 am two business days before the scheduled auction time, so that we may assist you with banking arrangements. International customers must establish prior payment arrangements before they will be issued a bidders number. If prior arrangements are made with the sale manager, payment for antiipated online purchases may be made prior to the sale by approved check, credit card, certified check, or bank wire transfer. I understand and agree that I, as an online bidder, am hererby warned to perform all due diligence examinations of horses prior to bidding as I may deem necessary to back my judgment of horses with my money. I agree that, PRIOR TO BIDDING, I have the right to request information from the seller, inspect the horse, or have a veterinarian or my representative inspect the horse at my expense. In some cases, xrays of horses may be available for viewing by my chosen veterinarian in the repository, if there is one established, which may or may not be available online. Members of the AQHA Professional Horsemen's Association or other qualified horsemen will be in attendance at most sales, and they may be commissioned by me to inspect any horse I may wish to purchase. Veterinarians are also available at all sales to inspect horses. I agree that by placing a bid through online bidding, I have performed sufficient examination of the horse to make the purchase. Once I have placed a bid through the online auction, I specifically waive my right to dispute the purchase of the horse due to any faults or points of conformation or disposition that could have been observed by an examination of the horse. I understand, and agree, that by making a bid on a horse, and if that horse is struck down to me for the amount of that bid by the auctioneer and charged to my online bidder number, that I am entering into a binding, non-negotiable, non-cancellable contract for purchase of that horse AS IS and WHERE IS, with all known and unknown defects, if any, which may concern, but are not limited to, soundness, disposition, training, marketability or usability for any specific purpose. Furthermore, I agree that I WILL NOT CONTEST the validity of this purchase through my credit card company which is used for this transaction. 5. I understand that I, as the Buyer, WILL ASSUME ALL RISK AND RESPONSIBILITY for horses purchased at the fall of the hammer / end of the auction, and that I must have arrangements for transportation and board for any horse(s) purchased. Furthermore, I authorize Alan Parker Auctions to process my credit card for any expenses related to the purchase and care of the horse. 6. Horses are offered for sale in accordance to the laws of the state in which the sale is held. The highest bidder will be the buyer. By making the highest bid online, the buyer acknowledges that he/she has purchased that horse, and accepts full responsibility for that horse and agrees to make prompt settlement for that horse (#4). 7. ALL REGISTRATION PAPERS WILL BE WITHHELD BY THE SALES MANAGEMENT until all the appropriate funds for payment of the horse have been verified and have cleared the drawee's bank or otherwise become unconditional credit of payment of account. Upon payment in full, all original registration certificates and transfer papers will be forwarded by the Auctioneer directly to the uyer for transfer of registration into the Buyer's name. 8. Every effort has been made to insure correctness of the catalog; however, Alan Parker Auctions, Auctioneers and Sales Staff will not assume and will not accept any responsibility for errors or omissions. 9. DISPUTES: I agree that I waive my right to dispute this purchase through the credit card company which issued the card used for the purchase of the horse. I agree that if I make claim of misrepresentation or fraud against the seller, I will submit information to support my claim to Alan Parker Auctions in writing. These claims will be investigated, and a fair solution will be sought between buyer and seller, with the Auction Company acting only as a mediator. If the matter is not resolved by the recommendation of Alan Parker Auctions, then the buyer and seller waive the right to litigate the issue and agree to submit to BINDING ARBITRATION, with the losing side paying for this service. This BINDING ARBITRATION will be held in Hillsborough County, Florida. In any procedures arising out of, regarding or related to this Agreement, the party found to be at fault shall pay to Alan Parker Auctions, all costs, expenses and attorney's fees incurred by Alan Parker Auctions having to do with the dispute. Any parties to the sale may bring no action, regardless of form, including arbitration, more than one year after the cause of action has accrued. Should either party fail or refuse to cooperate upon a demand for arbitration, the non-cooperative party shall automatically be declared the defaulting party by the arbitrator. In no way will Alan Parker Auctions, nor any of its principles, employees contractors or anyone else in the service of, or in any way connected to the auction company, be held liable in any way for the eventual outcome of such BINDING ARBITRATION. In no event will Alan Parker Auctions LLC be held responsible for having made or implied any warranty of merchantability or fitness for any particular purpose. Alan Parker Auctions will not be held responsible for any errors or omissions in the descriptions of the lots of the auction. 10. I, as Buyer, hereby waive my right to a tiral by jury pertaining to any matters in any way connected to, or resulting from, my purchase of a horse through this online auction. 11. I AGREE THAT THE ACT OF APPLYING FOR A BUYERS NUMBER AND PLACING A BID ON A HORSE IN THIS AUCTION CERTIFIES THE FACT THAT I HAVE READ, UNDERSTAND AND AGREE WITH THE TERMS AND CONDITIONS STATED HEREIN. 12. Bidder acknowledges and understands that internet bidding may or may not function correctly the day of the sale. Internet bidders who desire to make sure their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. 13.
