It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Basinger Auctions reserves the right to withdraw or re- catalog items in this auction. In default of payment of bills in full within the time herein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice and deficiency, together with all expenses and charges of re-sale will be charged to the defaulting purchaser. SALE BY COUNT, WEIGHT OR MEASURE: Where items are to be sold by estimated count, measure or weight, the purchaser will be billed for and required to pay for the estimate count, measure or weight. If, when delivered or picked up, any shortage exists, the purchaser will still be responsible for the count listed in the catalog or announced in the description. ABSOLUTELY NO REFUNDS OR CREDITS WILL BE GIVEN. REMOVAL: For items that are to be picked up on-site, removal shall be at the expense, liability and risk of the purchaser. Purchases will be delivered only on presentation of a paid in full bill. Auctioneer shall not be responsible for any items once sold and good not removed within the time specified, unless the winning bidder is an online bidder and the item is to be shipped. CLAIMS: No claims will be allowed after goods are removed or shipped from the premises. RECORDS: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute. PERSONAL & PROPERTY RISK: Persons attending during an exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release the auctioneer from liability therefore. Neither the auctioneer nor his principle shall be liable by reason of any defect in or condition of their premises on which the sale was held.
