TERMS & CONDITIONS – MOTLEY’S ONLINE AUCTION
THESE TERMS AND CONDITIONS ARE NOT ALL INCLUSIVE
BUYER BEWARE: All item(s) sold “AS IS”,“WHERE IS”, and WITH “ALL FAULTS' ALL SALES FINAL! NO REFUNDS!
Buyer will incur a $5 a day per lot storage fee for their winning items remaining after the pick-up date.
PREVIEWS: All merchandise is publicly displayed prior to auction. We recommend that each item be examined thoroughly. Internet purchasers are urged to have items inspected by an independent appraiser or a third party consultant. Neither Motley’s nor the consignor makes any warranty or representation with respect to the correctness of the catalog. Prospective bidders are urged to inspect property before bidding to determine condition and whether or not items have been repaired, restored, or damaged. Most of the items described in the catalog have come from estates and have, therefore, been subjected to extensive use. ALL SALES ARE FINAL! No items may be returned for credit; however, items may be resold for the new purchaser at the next available auction.
BIDDING: Property will be designated to the highest bid. Once a bid is submitted it cannot be retracted. Should a dispute arise between two or more bidders, the item will be put back up for resale. The Auctioneer has the right to refuse any bid not commensurate with the value of the item being sold. The Auctioneer may reject any raise in the bidding which is less than the amount being called for. If any dispute arises after the sale, Motley’s sale records shall be conclusive in all respects. Consignors may not bid on their own property. Pooling or collusive bidding will not be tolerated.
Motley’s reserves the right to protect the consignor’s interest in any and all lots sold.
Bidder is responsible for removing all parts of lots sold. No pieces or portions of any lot shall remain at the auction site; any items left after the last pickup date shall be subject to storage/disposal fees.
Motley’s shall not be held responsible for any failure of any electronic equipment or electronic connections.

SUCCESSFUL BIDS: Should my bids be successful, I personally guarantee payment for the items purchased according to the terms and conditions of the sale and I further understand that Motley’s has the right to pursue the legal means necessary to collect any funds due and that I am liable for any costs incurred in the collection of said funds, which can include, but are not limited to: storage fees, attorney's fees, court costs, insurance, transportation, rigging, etc. I realize I may need to arrange for additional help for the removal of large pieces. I understand that though I may not have physically examined the items on which I am bidding, that ALL SALES ARE FINAL, there are no returns, and I cannot cancel the sale of purchases made at this auction. I also understand that Motley’s may, at its discretion, charge my credit card for purchases made over $1,000.00 prior to the auction’s close. My 25% deposit on a successful bid is non-refundable and may be placed on my credit card. Although Motley’s makes every effort to execute the bids, I, the undersigned, understand that missed bids by Motley’s or any internet issues that arise at any point during the auction process are not the responsibility of Motley’s and I, or any agents on my behalf, will hold Motley’s harmless. I, as the winning bidder, agree to pay an administration fee per lot which will be assessed on any lot or lots on which I fails to honor my bid plus any attorney fees associated with the collection of this fee and any other monies due to Motley’s.
BUYER'S PREMIUM: A buyer's premium will be applied to the successful sale price for all bidders of 15% on each lot. This premium will be added to each and all lots sold in the auction. Please bid accordingly.
PAYMENT: Payment is due by 2/24/2012 at 4PM. Payment shall be made in the form of cash, MasterCard, Visa, Discover, and wire transfer. NO TRADING OF AUCTION ITEMS: This means buyers cannot sell any item or part of any lot to anyone else while either party is on the auction premises. No items will be switched between buyers even with both buyers present. Violators face permanent expulsion from the auction premises and all future sales.
LOCAL SALES TAX DUE: The Purchaser is required to pay local sales tax on the purchase price and the buyer’s premium. A valid tax exemption form must be submitted at the time of registration if you are tax exempt.
REMOVAL:Buyer agrees to remove all purchased property from the auction site on 2/23/12 from 9AM to 4PM, 2/24/12 from 9AM to 4PM and 2/27 - 2/29/12 from 9AM to 1PM. A checkout person will be at the auction site (4402 W. Broad Street) to verify your paid receipt. This checkout person will show you the location of your assets within the building but is not a mover and will not assist in loading so please bring any help you may need to move assets out of the building. Buyer is responsible for any boxes, packing material, hand trucks, or dollies they may need to remove their purchases. Buyer is responsible for any damage done to the building or grounds in the removal of their purchases. Buyer must remove the lot(s) in its(their) entirety. Buyer will incur a $5 a day per lot storage fee for their winning items remaining after the pick-up date. Please be aware that Motley's does not ship. You must contact a shipping company for this service. We suggest using Handled with Care at (804) 513-3717 for your shipping needs.
INSURANCE: The undersigned agrees to have full insurance coverage on all equipment and vehicles purchased at this sale and is responsible for any damage in removal of purchases.
