All property is sold “AS IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection. The auction company is working solely on behalf of the seller. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor of the auction merchandise. United Country - Shobe Auction & Realty may attempt to describe the merchandise in advertising, on the internet and at the auction BUT MAKES NO REPRESENTATIONS. In no event shall United Country - Shobe Auction & Realty be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. BIDDER SHALL BE THE SOLE JUDGE OF VALUE.
Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. United Country - Shobe Auction & Realty shall endeavor to describe in detail each item and any pertinent information about it.
United Country - Shobe Auction & Realty will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold AS IS and that they may not return any item they purchase.
At the fall of the Auctioneer’s gavel, title to the offered property item shall pass to the Buyer acknowledged by the Auctioneer, and the Buyer shall, (a) assume full risk and responsibility for the property item and (b) pay the full purchase price.
SALES TAX: None charged.
This is not an approval sale. All sales are final and items may not be returned. If the description of any lot is materially incorrect, the lot is returnable if returned within five calendar days of receipt, and received by the Auction Company no later than 20 calendar days following the auction date.
The Auctioneer reserves the right to reject any bids. The highest bidder acknowledged by the Auctioneer shall be the Buyer. In the event of any dispute between bidders, the Auctioneer will have the absolute and final discretion to either determine the successful bidder or to re-offer and resell the property item in dispute.
After the purchase price has been paid in full and after the sale has been completed, property must be removed from the auction at the Buyer’s expense. The Auction Company will, as a service to Buyers, arrange to have the property packed, insured, and shipped at the request, expense and entire risk of the Buyer. Any claims will be between carrier and Buyer.
Some items of property may be offered subject to a “reserve” or a confidential minimum price below which the item will not be sold. In such instances, the Auction Company may implement the reserve by bidding on behalf of the consignor, house or owner of said consignment, pursuant to Montana law.
Neither the Auctioneer nor Consignor make any representations whatsoever that the Buyer of a work of art will acquire any reproductions rights thereto.
