Terms and Conditions of Our Gun Sales. AUCTION TERMS & CONDITIONS ARE VERY IMPORTANT! READ CAREFULLY BEFORE YOU ATTEMPT TO BID! ONCE YOU BID, YOU WILL BE BOUND LEGALLY BY THE TERMS AND RULES THAT ARE STATED HERE: KNOW YOUR LAWS BEFORE BIDDING: We are an FFL dealer, so all federal and state firearm laws govern every aspect of these live/online auctions and any infractions will be immediately reported to local law enforcement agencies and the ATF. You must be 18 to purchase rifles or shotguns and 21 to purchase a handgun. You must be age 18 to purchase long gun ammunition and age 21 or older to purchase handgun ammunition. You are responsible for knowing if your state bars a certain type of firearm/ammo/accessory from being shipped to you. If you purchase an item that cannot be shipped to your state, we will auction this item at the next auction and mail you a check minus the 25% consignment fee. Know your state/federal firearms laws BEFORE bidding. Note also that Gilbert and Associates does NOT under any circumstances pay, nor are we responsible for, any fees associated with your hometown FFL – that is between you and your FFL dealer. Your bids are FINAL and constitute a binding contract. You are responsible for watching any gun on which you are high bidder and determining that you are the winner of the auction. BUYER’S PREMIUM AND SALES TAX: All online bid prices “hammer prices” ("hammer prices" mean the price at which a lot is knocked down to the purchaser) will be subject to a buyer’s premium of 18% payable by the purchaser. This is not an aggregate percentage on the total items bid, but rather a per item percentage rate. The premium is added to the purchaser's successful bid and the two together equal the total purchase price. Generally, all items shipped out of state are tax free sales. Indiana bidders must pay 7% Indiana sales tax unless we receive prior to checkout, an Indiana Sales Tax Exemption Form. This form must be on file prior to shipment. IMPORTANT: We are not responsible for computer malfunctions during the auctions and we are not responsible for “electrical blackouts” or any other acts of Nature. We reserve the right to resume or restart an interrupted auction. IMPORTANT: Make sure you hit the “Refresh” button frequently so you can assure you are the high bidder at any given time and in fact the winner. We can supply more digital photos of each firearm if you wish Using YOUR firearms knowledge and experience, form your own opinion of the firearm and bid accordingly. If in doubt, DO NOT BID. All guns are sold as is, where is. Period. THERE IS NO INSPECTION PERIOD OF ANY KIND ONCE THE FIREARM IS PURCHASED AND RECEIVED. This is a real AUCTION and the majority of these guns are estate firearms from the deceased - the estates are paid and the sale is final. We do not test fire each gun and therefore do not guarantee that they will fire correctly or function correctly. We are not gunsmiths and do not take guns apart – we don’t have shotgun bore gauges; nor would we know if all of the internal parts are present. All gun sales are final. Any internet descriptions of the sale guns are meant merely as a guide - in many cases we had to rely on the consignor's description, so make your own determination as to its worth and validity. We offer no guarantee or warranty on these firearms. All consignors' names are withheld due to security reasons. As per contract, consignors may not bid on their firearms, nor may they purchase them. Contact us if you need more digital photos or description. We will be more than willing to help you! BUYERS OUTSIDE THE USA: No guns will be sold to buyers outside the USA. Our Federal Firearms License does NOT allow us to ship guns out of the USA. Do NOT bid if you are located outside of the US. TAKING POSSESSION OF AUCTION FIREARMS: Here at Gilbert & Associates Auctioneers we observe all Federal and State gun laws. We hold a Federal Firearms License. The same person who registered the bid number must be the one to pay and pick up the auction firearm(s) at the conclusion of the sale. AVOID THIS PROBLEM - DO NOT UNDER ANY CIRCUMSTANCES BID FOR ANOTHER PERSON. Firearm sales to non-licensees (with the exception of muzzleloaders or antique arms manufactured before 1898 or non-guns) will be subject to and must pass the FBI Instant Check - NICS. The only exception is if you hold a valid Federal Firearms License. CAREFULLY NOTE: As per ATF instructions, we send our FFL only to other FFL's. If you are NOT an Indiana resident, you may not take direct possession of a handgun (FFL dealers may take immediate possession of qualifying handguns) - see next section below. If you delay after your Instant Check, you will merely pick up your auction firearm(s) later. If you deny after your Instant Check, you will NOT take possession of your auction firearms or ammunition and they will be sold at our next available auction and a check will be mailed to you for whatever the gun brings minus a 25% commission fee. If you know you are not supposed to possess a firearm, do not bid at our sales. We will summon law enforcement officials on the matter. AUCTION GUNS WON BY OUT OF STATE BIDDERS: If you are not an Indiana resident, we will ship your firearms to your local gun dealer when he FAXES us his signed, current FFL license, E-Mails a copy, or sends it in the mail. Handling and packing cost can vary from $15.00 for a small handgun to as much as 100.00 for a package including multiple pieces or firearms. This does not include actual shipping and insurance costs. All items will be insured for total purchase price (final bid plus premium). We will make every effort to ship to you as economically as possible. Please consider the size, number of items in the lot, weight, insurance value, and level of difficulty in providing protective packaging, when bidding on an item. We are experts at packing firearms correctly and will make sure your firearms get to your dealer safely. Our goal is to ship your firearms the same day we have the correct license and certified funds. We highly suggest that your local FFL dealer NOT open the shipping carton until you are present. All Sales are Final. PERSONAL AND PROPERTY RISK: Persons attending any aspect of the preview, auction, or during the removal of goods, assumes all risks of damage or loss to person and property, specifically releasing the auctioneer or his principals from any liability. Neither the auctioneer nor his principal shall be liable due to any defect in or condition of the premises on which the auction is held. CLASS 3 PURCHASES AND TRANSFERS: All firearms designated as Class 3 must be registered in compliance with the NFA registry. A $200 federal tax payment is required each time a functional NFA firearm is transferred to or from a private owner. This fee, as well as the Total Amount Due is due at the time of purchase in order to process the paperwork. The new owner of the Class 3 firearm will be required to complete 3 forms: 1) ATF Form 4, 2) fingerprint card, and 3) ATF form 5330.20 Certificate of Compliance. These forms will be provided to you by our Class 3 Dealer, GUNS & ORDINANCE. Note: if state or local law requires a permit or license to purchase, possess, or receive NFA firearms, a copy of the transferee’s (buyer) permit or license must accompany the application.. The BATFE says that it can take up to 90 days or more for approval. Our dealer will receive back one of the Form 4’s (they are sent in duplicate) with a Federal Tax Stamp attached to it. This is given to the new owner when he/she picks up the NFA firearm. No further tax is due. The following states do not allow individuals to own machine guns: California, Delaware, Hawaii, Illinois, Iowa, New York, Rhode Island, Washington D.C., and Washington. Consult with your federal, state, and local laws, law enforcement personnel, or legal counsel to make sure you may legally own, possess, or use the purchased firearm(s) and that all fees, licenses and approvals are completed.
