Colorado Sales (7.63%) tax will be charged unless the buyer provides a Colorado Tax Resale Certificate or the purchases are being shipped out of state by a 3rd party shipper and a Bill of Lading is provided. Out of state Resale Certificates are not valid in Colorado. Bidders should send their resale certificate to auctioneer before bidding is complete, otherwise you will be charged sales tax. All items in the auction are being sold, “as is, where is” without warranties or guarantees of any type and with all faults. All purchases, must be removed on December 14, 15, 16 from 9 am until 4 pm. With the exception of some of the pallet racks, trailers & portable buildings, the deadline for removal is Wed. Dec. 16 at 4pm. If you cannot remove your purchases in this time frame, do not bid. Any concerns regarding removal should be addressed to Auctioneer prior to bidding. Buyers assume all responsibility for loading, removal, transportation and handling of purchases. SHIPPING IS NOT PROVIDED. Seller is generously providing a forklift and operator to help load-out of heavy items. Seller will also palletize items for $40 per pallet (48"x40") for a 3rd party shipper to come pick-up. Transport companies should be scheduled for Wednesday Dec. 16 as it will be crowded the first two days. ANY ITEMS REMAINING AFTER THE DEADLINE WILL BE CONSIDERED ABANDONED, DISCARDED AND NO REFUNDS WILL BE GIVEN. Any correction to count of items in a lot, must be made prior to the items being moved from their original location on site. After items have been moved, there will be no change to a count on any lot. Equipment will be disconnected from electrical, water and gas prior to check-out. NOTE: This auction location is a 2-story building, some of the items are located upstairs and there is NO elevator. Please come prepared. If you choose not to inspect the merchandise prior to bidding, do no complain about the condition. Auctioneer recommends that everyone inspect before you bid. Seller, Auctioneer and buyer expressly agree that Buyer is responsible for and agrees to indemnify Seller, Auctioneer and their respective affiliates for any and all damages (whether based on contract, tort, warranty, negligence, strict liability or any other legal theory, and including special, incidental and consequential damages), losses, expenses, attorneys’ fees, court costs, etc., that arise out of or result from the removal, possession or use of any items purchased at auction, or any other claim regarding the use or possession of any asset purchased at auction.
