REGISTRTION: All information provided by bidder/buyer during the registration process must be current, complete, and accurate. Bidders must be 18 years of age or older. Conduct of the auction and increments of bidding are at the direction and sole discretion of South Auctions & Associates. Auctioneer and staff, acting on their own behalf, reserve the right to bid on any auction item as allowed by the State of Ohio. a. By registering for this auction, bidder agrees to receive emails from South Auctions & Associates regarding future auctions. You will be able to unsubscribe at any time. b. In order to actively bid on this auction, you must register with an active Credit Card (VISA, Master Card, or Discover). c. Online bidding is a convenience offered to South Auctions & Associates customers and while we make every effort to execute your instructions regarding your online bids, South Auctions & Associates is not liable or responsible for any errors or failure to execute such orders. d. South Auctions & Associates reserves the right to refuse to accept bids or approve bidders for any reason. Some bidders may be required to have a “hold” placed on their credit card in order to be approved to bid. 2. DISCLAIMER: All lots are sold as shown and described, with any imperfections or faults. South Auctions & Associates are not responsible for errors of description or authenticity of any lot or for any defects in the lot. The absence of a condition report is not in any way an indication of any item’s condition. Any condition reports provided by South Auctions & Associates are based solely on our opinion. We do not guarantee the working condition of any mechanical type items, especially but not limited to clocks. There is no warranty given or implied whatsoever to the buyer. No credits or refunds shall be given. All sales are final. 3. DISPUTE: Should any dispute arise; South Auctions & Associates shall have full discretion to settle the matter. They may refuse any bid, divide any lot, combine any lots, withdraw any lot, or any other means not specifically mentioned to settle any dispute arising from any auction. In no event will South Auctions & Associates’ liability to a buyer ever exceed the purchase price paid. Any and all legal disputes or any litigation that may arise, for any reason, between South Auctions & Associates and a bidder shall be heard and or tried in Lebanon Courts, Warren County, Ohio. Successful purchasers or bidders agree to pay any and all reasonable attorneys' fees and costs incurred by South Auctions & Associates, the seller and or their assigns, agents or employees in the commencement or defense of any action here under as well as in the collection of any obligation here under. 4. CHOOSE WISELY: Please choose and bid wisely. When you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness, or suitability for intended use, please bid accordingly. Bidding is a contractual agreement you enter into with South Auctions & Associates and our sellers to purchase any and all items where you are the high bidder at the end of the lot/item/auction hammer. South Auctions & Associates does not offer Buy Backs or returns on any items. 6. MAXIMUM BID: When you place a maximum bid, the current bid price doesn't automatically jump to your max bid. Your bid goes to the next highest increment and increases as other people bid against your bid. The computer will automatically bid up to your max in the increments specified. 7. BUYER PREMIUM & PAYMENT: There will be a 20% Buyer’s Premium fee applicable on all purchases. Valid Credit Card required for bidding verification & payment approval. We accept VISA, Mastercard and Discover and payment for all purchases can be made by credit card or Wire Transfer ONLY. We will call you within 24 hours after the close of auction to find out your payment and shipping preference and/or get information necessary for Wire Transfer. If you inform us that you choose Wire Transfer as your method of payment, you have until Saturday, April 6th at 5 p.m. to complete the transfer, for full invoice price, to our Escrow Account. If we cannot make contact with you and do not hear from you within 24 hours after the auctions closes, your credit card will automatically be charged the full invoice amount. South Auctions & Associates reserves the right to cancel any unpaid invoice after that time has expired and to ban the bidder from future sales. We do not accept partial payments. Invoices must be paid in full before we will start the shipping or delivery process. All payments must be in U.S. Funds. Currency Type: USD 8. AUCTION ENDING: This auction is a Soft Close Auction. Beginning at the stated closing time, the auction software will conclude bidding for one lot every few seconds in catalog order with the following exception: if a bid is placed in the last two (2) minutes remaining for that auction lot, bidding for that lot will automatically extend the auction for additional two (2) minutes. An e-mail of invoice will be sent to the winning bidder/buyer of each auction after auction has completely closed. Immediately upon the fall of the hammer/close of the lot auction, title will pass to the highest bidder who thereupon assumes full risk and responsibility for the property, including the obligation to immediately pay the full price plus and the buyer premium fee. South Auctions & Associates Company shall have the right to reject any bid from anyone who has not established credit with Proxibid prior to the auction. 9. SHIPPING, PACKING, INSURANCE & PICK-UP: WE DO NOT SHIP. We use 3rd party shipping & packing. Arrangements and costs are the sole responsibility of the buyer. Buyer will pay packing, shipping and insurance costs as charged directly to the professional company of his/her choice. Buyer should request a shipping quote prior to bidding. BUYER SHALL ARRANGE & PAY FOR SHIPPING! ALL PACKING & SHIPPING IS OUTSOURCED. WE DO NOT PACK. Shipping is not refundable. a) Shipping: The Buyer is responsible for all shipping and packing costs. Buyers may contact the UPS Shipping Center Store, 726 E. Main St., Lebanon, Ohio (513) 836-3985. (Hours M-F 8:30 am -7 pm & Sat. 9am-4pm). If you arrange shipping with this UPS Store, we will deliver your item(s) to the store at no additional charge. If you select a different shipping company, all shippers must be responsible for picking up purchases at our business no later than 5:00 P.M. on Monday, April 8, 2019, unless other arrangements have been made directly with South Auctions & Associates. b) Shipping Restriction: due to present ivory restrictions we cannot ship to California, Hawaii, New York state or New Jersey. c) Pick-up: If buyer is within driving distance to Lebanon, OH 45036, bring a copy of your paid invoice with you. No items will be released for shipping or pick-up until settled/paid in full. South Auctions & Associates are not responsible for packing or shipping of any purchase. If any assistance is provided, we will certainly try to provide good care of your merchandise, however it is at the risk of the buyer. In no event will South Auctions & Associates be responsible for any damage, regardless of the cause. 10) TERMS OF GUARANTEE: Each item or lot will be sold AS IS, WHERE IS with all defects and faults. No warranties or guarantees of any kind will be given by Seller or Auctioneer including any warranty of fitness, merchantability or suitability. Bidders should, whenever possible, carefully inspect each lot to determine condition and contents. All weights, counts and measurements are approximate. Bidder acknowledges that all lots were available for inspection prior to the Auction and that he or she relied solely on their own inspection of the lots and not any information listed in the catalog or otherwise provided by Auctioneer, the Auction staff or Seller. It is the responsibility of the buyer to obtain all possible lot information prior to bidding. If you are not completely satisfied with an item before you bid, DO NOT BID.
