In-Person Pick-up: Winning bidders may pick up their items in person during the above listed times and location in Nowthen, Minnesota. Buyers should bring cases to transport the guns they buy. When arriving at AAA Auction the Buyer shall fill out a 4473 form after which AAA Auction shall run a background check on the Buyer. If for any reason the transfer is denied by the FBI, then AAA Auction shall refund the Buyer’s winning high bid amount, but AAA Auction shall keep the 20% Buyer’s Premium as liquidated damages. Buyers for whom AAA Auction receives a “Delay” response shall be promptly notified by AAA Auction when the final response from the FBI is received. If the response is to proceed with the transfer the gun, the Buyer shall promptly schedule a time with AAA Auction to pick up the gun. If a Buyer fails to pick up his or her gun at the times listed above or within two weeks after being notified that the FBI has given a "proceed", AAA Auction at it's discretion may void the sale of the gun. If this occurs then AAA Auction shall refund to the Buyer the winning bid amount, but AAA Auction shall keep the 20% Buyer's Premium as liquidated damages. If AAA Auction does not void the sale and the gun is picked up after said two-week period, then Buyer shall pay AAA Auction a late pick-up fee of $10 per week or any part thereof beginning two weeks after the FBI issues a "proceed" to transfer the gun. Gun-Related Terms: All federal, state and local laws apply to the sale and transfer of guns at this auction and the Buyers are responsible for knowing all federal, state and local laws of the location where the gun will be transferred. In Minnesota, Buyers of handguns must have a carry or a purchase permit or an FFL license to take possession of a handgun. Handguns may be purchased by a Buyer without the necessary permit; however, if that occurs AAA Auction shall retain possession of the handgun for up to 2 months while the Buyer obtains the necessary permit. Once the Buyer obtains the required permit the Buyer shall fill out a 4473 at the AAA Auction location and after a successful background check the gun shall be transferred to the Buyer. If more than two months go by without the Buyer providing the necessary permit to AAA Auction and passing the background check, then AAA Auction may cancel the sale and refund all of the Buyer’s winning bid amount to the Buyer but AAA Auction shall keep the 20% Buyer’s Premium as liquidated damages. By purchasing a firearm from AAA Auction the Buyer agrees to follow the manufacturer’s safety instructions and to only use the firearm in a safe manner in an approved area for a legal purpose. The Buyer assumes all responsibility for the legality of the gun when he or she purchases it. The Buyer must be the actual buyer of the gun and not be buying it for another person. Buyers of rifles and shotguns must be 18 years old. Buyers of handguns and guns with pistol grips (AR type rifles) must at least 21 years old. Ammunition: AAA Auction disclaims any knowledge of the history of any of the ammunition it sells and does not know whether any ammunition it sells was factory loaded or reloaded. Buyer’s use of the ammunition is at his or her own risk. Buyer shall hold AAA Auction harmless and shall indemnify AAA Auction and its staff from any and all claims for damages, loss, injury or the like arising from the sale and use of said ammunition. AS IS: All items sold by AAA Auction are sold AS-IS without any warranties express or implied. All sales are final. No returns shall be allowed. Descriptions, illustrations, pictures, sounds or videos posted on the AAA Auction or Proxibid websites are for informational purposes and should not be read as creating a warranty. Photos may not be relied on for disclosure of all defects. All measurements are approximate and AAA Auction encourages bidders to physically examine items before bidding on them. Buyers understand that AAA Auction has not tested any item unless that it is specifically stated in the description and that AAA Auction has not examined the internal mechanical workings or firing mechanisms of any of the items. In addition, AAA Auction does not know if all of the pieces of the model planes or items sold are present and makes no warranty to that effect. AAA Auction strongly recommends that Bidders personally inspect the items during the preview times scheduled and make their own decisions on the nature, quality, authenticity, color, size, condition and value of the items before bidding on them. Internet: AAA Auction and Proxibid do not guarantee continuous and uninterrupted internet services and Buyer understands that internet service may be effected by many things such as spam filters, lack of storage space and rules set by various internet providers. AAA Auction shall not be responsible for any missed bids, lost or misdirected emails, slowness in the transmission of bids, technical problems or human error that results in the loss of the bidder’s internet connection to AAA Auction or Proxibid. For anyone who is concerned about not getting a bid in in time, we strongly recommend that the Bidder place a maximum bid on the item before the auction closes.
