TERMS & CONDITIONS 1. All Internet Bidders must provide a Bank Letter of Guarantee to Leake Auction Company as per sample letter. All Letters must be faxed to 918-254-4882. 2. All internet bidders are required to place a $2500 deposit with Leake Auction Company prior to the auction. Said deposit will be in the form of a credit card. 3. There is a 3% Internet Purchase Fee charged on all online purchases. This means buyer agrees to pay Leake Auction Company Buyer’s Premium of 13% on cars and 18% on memorabilia. 4. Sales Tax will be charged on all lots when applicable. 5. Payment in full must be made the first business day following the Auction in the form of Cashier’s Check, Company or Personal Check or wire transfer. 6. All purchases must be removed from the premises the first business day following the auction. 7. Bidders will be held personally liable for any bids made with their Bidding Number. 8. The highest bidder for each Lot shall be the Purchaser, in the event of any dispute The Auctioneer shall have absolute discretion either to settle such dispute or to re-offer the lot for resale. 9. Leake Auction Company, The Auctioneer and ProxiBid.com accept no liability for loss or damage from any Lots not presented for sale. 10. Leake Auction Company, The Auctioneer and ProxiBid.com have described the Lot(s) in the catalogue to the best of their ability and belief from information furnished by the seller(s) who shall be alone responsible for any error or misstatement. Leake Auction Company, The Auctioneer and ProxiBid.com undertake no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalogue or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. 11. Each and every Lot is sold “as is”. Leake Auction Company, The Auctioneer and ProxiBid.com provide no guarantees or warranties (expressed or implied) in respect of the items contained in the Lot. All representations made by Leake Auction Company, The Auctioneer and ProxiBid.com, their servants or agents are to be considered lay opinions only and Leake Auction Company, The Auctioneer and ProxiBid.com accept no liability for any purchase made by a Buyer in reliance upon them. 12. Leake Auction Company, the Auctioneer, ProxiBid.com or Seller provides no insurance as of the fall of the gavel. The Buyer is strongly encouraged to insure the item(s) purchased against all losses from the fall of the gavel. 13.
