By registering and bidding, the bidders acknowledge they understand and agree to the terms and conditions of the auction. Buyers are required to complete their research, due diligence, and inspection on the property, real or personal, being offered at auction prior to submitting their auction bid. No returns are allowed. CREDIT CARD CHARGEBACKS ARE NOT ALLOWED. All Sales Final: All property is sold “AS IS”, “WHERE IS” with NO WARRANTIES implied or expressed, and ALL SALES ARE FINAL. All Property, real or personal, is open to thorough public inspection prior to the auction. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value, suitability for a particular use, or any other determinative factor. JT McWilliams Auctioneers, LLC shall endeavor to describe in detail each item of merchandise and any pertinent information about it, in advertising, on the internet, and at the auction, but makes no representations. JT McWilliams Auctioneers, LLC shall endeavor to ensure photographs of auction items match the descriptions found in print and online. However, errors may occur in the listing and in that case the description will take precedence over the photograph in determining the item being bid on. If you feel there is a discrepancy or error between a listing’s description and photo please call the auctioneer for clarification. In no event shall JT McWilliams Auctioneers, LLC be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself, nor shall JT McWilliams Auctioneers, LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. The Seller shall have no obligation for repairs or replacements noted in any inspection(s) made by or for Buyer. Such repairs or replacements shall be the sole responsibility of the Buyer. Please review all information provided and seek appropriate assistance prior to bidding. Buyers Premium As Follows: Onsite Buyer’s Premium: 6% with a cap at $500 per lot. Internet Buyer’s Premium: 8% with a cap at $750 per lot. The buyer’s premium will be added to the high bid to determine the final contract price. Sales Tax: Sales tax will be added to all purchases after the buyer’s premium. In order to be tax exempt you must provide JT McWilliams Auctioneers, LLC with your tax exempt certificate. Certificate may be faxed to 770-822-0425. Payment: All payments must be made in full on the day of the sale. Internet buyers may have until the next business day after the sale to pay. "NO" items may be removed until paid for in full. Acceptable Forms of Payment: Credit Card (Visa, MasterCard, Discover; a 3% convenience fee applies to credit card payments), Cashier’s check, Personal or Business check with a bank letter of guarantee on bank letterhead. Example Bank Letter: Mr. (customer name) is a customer in good standing at our bank. We will guarantee the payment of check on this account (acct #) up to (specify amount) Dollars for purchase at your auction on (date of auction). Removal: ALL ITEMS MUST BE REMOVED BY 5:00 PM, WEDNESDAY OCTOBER 26, 2011. All items must be paid for IN FULL before they can be removed from the auction site. Winning bidder agrees to pay all deficiencies; legal collection, and other fees including transportation and storage expenses associated with delinquent accounts or abandoned items. Purchases become the responsibility of, and shall be, and remain at the risk of the purchaser immediately upon acceptance of his/her bid. It shall be the responsibility of the purchaser to insure his/her purchases immediately. Shipping: Buyer is solely responsible for all shipping logistics and costs. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins.
