Terms and Conditions 1. Settlement: Full payment day of auction. Strictly cash, cashier's checks or check with letter of guarantee with a statement of limits on large purchases. Absolutely NO EXCEPTIONS. No drafts. 2. NO WARRANTY: All descriptions used in advertising and cataloging are believed to be correct; however, neither those descriptions nor any oral statements made by the Owner or the Auctioneers concerning any item shall be construed as a warranty, either expressed or implied. All items are sold AS-IS WHERE-IS. Measurements and footages in some cases may be approximated. 3. REMOVAL: All items become your responsibility when sold. Buyer assumes all risk of loss and damage to property from time of purchase. Owner and the Auctioneers agree that merchandise must be removed from auction site as announced by the Auctioneers auction day. Items left after this date may be sold for storage. LOADING WILL BE AVAILABLE AT THE SALE SITE DAY OF AUCTION AND FOR A LIMITED TIME THEREAFTER. PLEASE MAKE PLANS TO HAVE TRUCKING AVAILABLE. 4. RESALE: Auctioneers reserves the right to resell any property not paid for in full on auction day and/or any items not removed by the announced removal deadline date. The Buyer shall be responsible to the Auctioneers for any expenses of resale, collection and/or damages resulting from the resale. 5. DISPUTES: The Auctioneers shall designate the Buyer after each item is sold. If a dispute arises between two or more bidders the Auctioneer may, at his discretion, reopen the bidding. His designation of the Buyer will be final. 6. INJURY: Bidder agrees to hold Owner and the Auctioneers harmless for any personal injury to himself or his agents, and any property damage incurred on sale premises.
