Special Terms
1. By bidding on any item, the bidder shows acceptance of the terms of the auction. All announcements made day of auction take precedence over any written or verbal statements.
2. OHIO STATE ITEMS: We guarantee the ownership, age and authenticity of each Ohio State Memorabilia item to be as represented in the catalog, or at the time of the Auction. Descriptions & references are from family members and – or reliable sources and believed accurate. We will provide a certificate of authenticity for each item from Dr. Duffee’s collection.
COINS: Coins sell AS-IS with no warranties or guarantees expressed or implied. Photos are the only representation as to grading. All sales of coins are final. In no event shall Kramer & Kramer Inc. Auctioneers-Realtors be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose.
3. All Internet Bidders agree to pay a buyer’s premium equal to Fifteen Percent (15%) of the hammer price of each item they purchase. If the hammer price is $100, the buyer’s premium will be $15 for a total purchase price charged to the buyer of $115, plus shipping if applicable.
4. Bidders who bid from off site & are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine the value of each item, and bid accordingly. Bidders agree that under no circumstances whatsoever will the Kramer & Kramer, Inc. Auctioneers-Realtors ever be liable to any bidder for an amount greater than the hammer price of the item they purchased.
5. Kramer & Kramer Inc. Auctioneers-Realtors is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Kramer & Kramer Inc. Auctioneers-Realtors or anyone else if the Internet service fails to work correctly before or during the live auction. Kramer & Kramer Inc. Auctioneers-Realtors will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Kramer & Kramer Inc. Auctioneers-Realtors reserves the right to withdraw or re-catalog items in this auction.
6. Our on-line auctions move quickly! If you are interested in an item, bid quickly. If you win an item in the auction you will be notified by email. In order to have enough time to conduct authorizations, registration must be completed at least 24 hours in advance of the auction. The auctioneers shall advance the bidding at their own discretion. The Auctioneers may withdraw any item before or during the auction. The decision of the Auctioneer is final. The record of the auction made by Kramer & Kramer Inc. Auctioneers-Realtors shall be conclusive.
7. All accounts must be settled at the conclusion of the auction. We accept Visa & MasterCard ONLY. Your credit card will be charged for your purchases plus a 15% buyer’s premium. A pre-auction authorization will be performed to establish available credit and you will be charged a non-refundable $1.00 for this service. Bidders further agree that under no circumstances will they initiate a charge-back on any credit card. Any bidders with credit cards that are declined on reconciliation day will be charged a $30 processing fee to run another credit card-NO EXCEPTIONS!
8. Shipping cost and insurance coverage are the responsibility of the buyer. We will use US Postal Priority Mail Shipping Boxes, etc at a cost of $10 per box, includes insurance up to $200.00. Any purchase over $200 will require additional insurance at a rate of $1.00 per $100.00. All items will be insured for the purchase price. Our first priority is to deliver your new purchase in excellent condition. Other shippers such as FedEx or UPS are available for additional costs.
9. Kramer & Kramer Inc. Auctioneers-Realtors may refuse to issue a buyer’s number to anyone for any reason. Bidder agrees to provide any identification the Kramer & Kramer Inc. Auctioneers-Realtors may request including but not limited to: drivers license, photocopies of driver’s license, credit cards, Social Security card, Passport or of the person. Bidder agrees to comply with any stated additional terms or conditions associated with particular items.
10. The purchaser agrees to pay all reasonable attorney fees and costs incurred by Kramer & Kramer Inc. in the collection of funds. The purchaser also agrees that a fee of 2.5% per month, with a minimum of $20, be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Preble County, Ohio.
11. We want you to be happy with your purchases. On-line bidding requires due diligence and trust on all parties. If you have questions about the merchandise, the time to ask questions is at least 48 hours in advance of the live auction.
