Online Auction Terms & Conditions: 1) Online Only Auction: (ie. Internet Auction) – The auction and the bidding shall be opened on Saturday, August 1st, 2015 at 10:00am. (CST) and bidding shall begin closing on Saturday, August 15th, 2015 at 5:00pm (CST). 2) Property Previews: Property inspections are available by contacting Darrin Addison, real estate agent at (620) 338-0894. It is recommended to all bidders to inspect the property prior to placing any bids in the auction. Property inspections are the responsibility of the bidders. Property is being sold “As Is, Where Is” with all faults and no warranty of condition is being made. Bidders must satisfy themselves prior to bidding. 3) Online Auction Registration/Process: The Online Auction is open to any properly registered bidder which submits a completed “Online Auction Bidders Agreement” which includes the “Terms and Conditions of Auction”. 4) No Financing Contingency: By participating in this auction, bidders hereby agree that their bid shall NOT BE SUBJECT to the bidder’s ability to obtain financing. By placing a bid in this auction, bidders are making a “cash offer” to purchase the property. Financing is NOT a contingency in the purchase agreement. 5) Buyer’s Premium: A One Percent (1%) Buyer’s Premium shall be added to the final bid price place online, which will determine the Total Contract Sales Price. Bidders hereby understand that the Buyer’s Premium of One Percent (1%) shall be added to the winning bid to create the Total Contract Sales Price for which they are obligated to pay for the property. 6) Contract Signing: Winning bidder hereby agrees to enter into a Contract to Purchase the property immediately upon being declared the Successful Bidder by the Auctioneer. Upon the close of the auction the winning bidder will be forwarded via email a Purchase and Sales Contract to Purchase the property. A signed copy of the contract must be received by United Country – Kansas City Auction and Realty on or before 5:00pm., on Monday, August 17th, 2015 (hand delivered, faxed, or scanned and emailed). An original signature agreement must be mailed to United Country – Kansas City Auction and Realty, 2820 NW Barry Rd., Kansas City, MO 64154, postmarked no later than Monday, August 17th, 2015. 7) Down Payment: A non-refundable escrow deposit of Ten Percent (10%) of the total contract purchase price (which includes the buyer’s premium) shall be wire transferred to the Title Company no later than 5:00pm., Monday, August 17th, 2015. The balance of the total purchase price will be due in full at closing. 8) Closing: Closing shall be on or by Tuesday, September 15th, 2015, at Taylor Abstract and Title Co., Inc, 114 West 5th Street, Larned, Kansas 67550. Out of state buyers will be afforded the opportunity to close via email, mail and wire transfer of certified funds. 9) Possession: Possession of the property will be given at closing and transfer of title. 10) Title Insurance: Title Insurance in the full amount of the purchase price will be provided by the seller. 11) Survey: Seller shall not provide a survey to the buyer, if a buyer desires a survey of the property it shall be at the buyer’s sole expense. 12) Taxes: Seller shall pay 2014 and all prior year real estate taxes. 2015 real estate taxes will be Pro-Rated to the date of closing. The 2014 taxes were $1,488.88. 13) Agency: United Country – Kansas City Auction and Realty and its representatives are Exclusive Agents of the Seller. 14) Technology Disclaimer: Under no circumstances shall Bidder have any kind of claim against United Country – Kansas City Auction and Realty, or anyone else if the Internet service fails to work correctly before or during the auction.
