Fleming Auction Conditions of Sale All items offered for sale are subject to the following terms and conditions. Bidding on any item indicates bidder's acceptance of these conditions. 1. A 13% buyer's premium will be added to the hammer price of each lot. 2. Sales tax is charged @ 7% when a vehicle is picked up personally by the buyer. There is no sales tax if a shipping company ship the vehicle across border lines. 3. If you are a registered dealer Fleming Auction has to have a current signed copy of your sales tax certificate as well as your dealers licence on file. Please fax to (904) 212-0108 or e-mail to peter@flemingauction.com. If we do not have this on file you will be charged sales tax. 4. All goods are sold "as is" and "where is". All sales are final. If goods prove defective after purchase, the buyer shall assume all costs for repair or servicing. Condition reports are not included. It is the sole responsibility of the prospective buyers to examine the lots before bidding. The auctioneer is not responsible for the accuracy of any printed or verbal descriptions. 5. The auctioneer has the sole right to settle disputed bids and decide whether or not to re-offer the lot. 6. The price at the fall of the hammer is final and indicates the conclusion of the transaction. The buyer assumes complete responsibility for the items. 7. Items may be withdrawn and or exchanged prior to the offering of each lot. 8. Some of the lots in the sale are offered subject to a minimum price. The minimum price is an agreed price by the seller and Fleming Auction. 9. Payments by Wire Transfers, Cashier's Checks & Money Orders are accepted. Credit and Debit cards also are acceptable up to $1,000.00 charge. When an item is more than $1,000 a wire transfer must be done. 10. Payment is due the first Monday after the sale for online buyers; and the same day for buyers attending the auction. Items can be removed immediately after the full payment of the invoice. The items will also be stored for pick up no longer than ten (10) days after the day of auction. The responsibility of theft or damage to a purchased item will become the responsibility of the buyer after full payment is received by Fleming Auction. Fleming Auction does not accept any responsibility for an item after payment is received. If the items are not collected within fourteen (10) days Fleming Auction will charge a storage fee of $50.00 or 1.5% of the hammer price (whichever is greater) per month. 11. Shipping has to be arranged by the buyer. 12. The bidder acknowledge that he/she clearly understands and accepts all conditions of the sale at this auction or any future auction held by Fleming Auction. The terms and conditions of this auction will remain in force and effect until such time that Fleming Auction changes said terms.
