Terms Of Sale

TERMSand CONDITIONS: All sales are FINAL and sold "AS IS, WHERE IS". Sales tax does not apply to coins. Winning bidders who reside in the state of Ohio must pay sales tax and it will be added to your final invoice. No buyers remorse! I have surfaced hunted, collected, bought, sold, and traded Prehistoric Indian Artifacts for 33 years. I have been a member of the Archaeological Society of Ohio for more than 20 years, and have been selling artifacts at auction, for other auctioneers in the State of Ohio for the past three years. I feel that through my years of being in the collecting community, I have a pretty good eye for determining the Authenticity of the artifacts that come from the Ohio region. I will also have numerous other collectors look at the artifacts that are being consigned to the auction, before the auction is advertised or posted online, as to insure that they are Authentic prehistoric artifacts. Auctioneer has final say on determining which bidder is the high bidder. Auctioneer has final say on resolving any bidding disputes, and any decision to re-open bidding is at his sole discretion. James W. Cross reserves the right to refuse admittance and/or participation in this auction to any individual or group. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. James W. Cross may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall James W. Cross be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. James W. Cross shall endeavor to describe in detail each item and any pertinent information about it. James W. Cross will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. James W. Cross is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction.
