Bidding
This is an unreserved auction. You, the buyer, acknowledges and agree that bidding at this auction is the legal equivalent of an irrevocable offer to purchase, unless otherwise prohibited by law or otherwise noted in these buyer terms. Once you have placed a bid and the bid is accepted by Premier Auctions, you are obligated to complete the transaction.
Premier Auctions reserves the right to accept or void any bid, whether winning or not, and in cases of dispute, Premier Auctions decision shall be final. Premier Auctions also reserves the right to withdraw an item from the auction.
Premier Auctions uses Proxibid as the internet bidding platform and is not liable for any claims or alleged loses related to the use of any technologies or processes they use in the auction.
Purchases
All items are sold on an 'As Is, Where Is' basis. There are no warranties on any item, unless otherwise stated.
Premier Auctions are not responsible for any error in the description or condition of items offered for sale. While we try our best to make sure the information we provide is accurate, Premier Auctions highly recommends that each customer satisfy themselves with year, make, model and condition of any of the items they wish to bid on. Nothing can replace viewing the asset in person on our viewing days.
Once items are sold, they are the responsibility of the buyer.
There is a 15% Buyers Premium applied to each item in the sale. There is also Canadian GST (general sales tax) of 5% applied to the total amount (buyers premium plus sale price) for each item purchased.
All assets will come with a 'clear' title, meaning free of any liens and encumbrances. If, for any reason title cannot be cleared, the liability (if any) of Premier Auctions shall not exceed 'refund of the funds paid at this auction' in exchange for the return of the encumbered asset (in a condition equal to that when it was sold on sale day).
Removal
Purchased items must be removed by Sept. 30, 2020. If they are not, and no arrangements were made with Premier Auctions regarding this, then there will be a $50 transport fee and and $20/day storage fee applied to each lotted item that remains. Full payment of outstanding transport and storage fees must be made before the buyer can remove the items. If a buyer fails to pay the outstanding fees before the start of the next Premier Auction, they then authorize Premier Auctions to consign the items left, on their behalf, unreserved and apply any proceeds from the sale to first pay all outstanding transport and storage fees, then commission (at our standard split rate). Any funds remaining from the resale of the items will then be disbursed by mail to the buyer. In the event that the outstanding fees and commissions are greater than the sale proceeds from the item, no funds will be disbursed to the buyer.
