APPALACHIAN EQUIPMENT SOLUTIONS (AES) AUCTIONS Terms and Conditions ANNOUNCEMENTS – All announcements made on sale day will take precedence over all printed material or advertising. BIDDING –A bid is a legally binding contract between bidder and Appalachian Equipment Solutions. By making a bid you are agreeing to all terms and conditions listed. ALL SALES ARE FINAL. It is the bidders responsibility to be aware of what they are bidding on. In case of a tie bid the auctioneer reserves the right to open up bidding between those bidders. Auctioneer also reserves the right to revoke bidding privileges from any individual. ONLINE BIDDING – A $500 Credit Card Authorization is required to participate in online bidding for this auction. If payment arrangements are not made within 5 days of the auction $500 will be charged and applied to the balance due. If no further payments or arrangements are made within 3 additional days the $500 will be transferred from a payment made to a restocking fee of items and the sale will be cancelled. If no purchase is made the credit card processor will return authorization funds to your account no later than the Friday following the auction. PAYMENT – Payment is due within 5 days of the auction and before any items will be released from our yard. We accept CASH, CASHIER CHECK, COMPANY or PERSONAL CHECK (accompanied by a bank letter of credit), or MAJOR CREDIT CARD. A 4% service fee will be applied to credit card purchases. LISTINGS – Every effort is made to provide accurate descriptions and pertinent details for each item, however, errors or omissions may be inadvertently made. AES or Auctioneers will not be held responsible for any misrepresentations on hours, mileage, etc. Previewing items is encouraged and items are available for preview the Thursday and Friday before the auction from 8-4 or by appointment. Bidders from offsite acknowledge they may not be able to inspect the items as well as they could in person. All bidders agree everything is sold AS IS WHERE IS and that they may not return or exchange any item. No warranty is expressed or implied. Bidders are held personally liable for bids made with their buyer number. SALES TAX – All purchases will be charged a 6% WV State Sales Tax unless a valid tax exemption form is provided at the time of payment. Sales tax is applied to total price of items (Hammer Price + Buyers Premium). PICKUP – All purchases are to be picked up within 2 weeks of the auction. Any items not picked within that time will be charged a storage fee of $25 per day per item. Pickup times are 10-4 M-F, unless prior arrangements are made. LOADING – Auction will provide assistance with loading Monday - Friday 10a – 4pm. We are not responsible for securing loads. RISK OF LOSS – Once the auctioneer accepts the winning bid on an item, it is considered SOLD. Buyer then takes delivery and assumes all risk of loss for the item. Buyer agrees to obtain full liability insurance on the item as may be required by law. AUCTION SITE – ALL BIDDERS ENTER THE AUCTION SITE AT THEIR OWN RISK. Regardless of cause, Auctioneer or Auction Company will not be responsible for injury to anyone at the auction site. TITLES – A $30 processing fee will be charged to the buyer of all titled items. Titles are not available on sale day and will be mailed via Certified Mail to the purchaser to the address on file approximately 10 days following the auction. No titles will be available if NO TITLE is listed in the description.
