A LATE FEE of $10.00 will be charged on the 5th day after auction.
Legal action will be instituted to collect any unpaid account and Buyer agrees to pay all costs of collection, including reasonable attorney's fee of THIRTY-THREE AND ONE-THIRD PERCENT (33 1/3%), plus a finance charge of TWO PERCENT (2%) PER MONTH (24

Buyer's will hold Hagenau Auction Service, LLC harmless for any and all shipping damages and disputes, it is the buyers responsibility to resolve it with the shipper. $5 handling fee will be charged for each package shipped.
Buyer agrees to handle Insurance claims through shipping agent.
Buyer is not required to use USPS (Postal Service) and may make shipping and / or packaging arrangements with any professional shipping company they choose.

ACCEPTANCE OF TERMS. Bidding on any item, whether in person, by phone, by absentee bid or via an internet auction indicates the bidder's agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Wisconsin. All bidders submit to the personal jurisdiction of the state and federal courts in Wisconsin. Should a dispute arise between Hagenau Auction Service, LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Waukesha County, Wisconsin. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid to them at the address they provided to register.
TERMS OF SALE. All Property is sold AS IS WHERE IS and ALL SALES FINAL. Please ask all questions before bidding. If you are unsure about an item, please do not bid, since all sales are final. We will be happy to answer any questions to allow for a positive auction sale. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. BUYER'S FEE. Buyers shall pay the final bid price of the lot, plus a buyer's fee for the lot equal to 19% of the final bid price for sales conducted via Proxibid.

WARRANTIES AND DISCLAIMERS.. All sales are final, with no returns or refunds. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Hagenau Auction Service, LLC will attempt to describe each item and any pertinent information about it. Hagenau Auction Service, LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the items itself, Bidder agrees that everything is sold as is and that they may not return any item they purchase.
