Auctioneer will attempt to describe items to the best of his knowledge but makes no warranties as to the final accuracy of descriptions nor the item’s merchantability or suitability for a particular purpose. All items are being sold "as is where is", and any descriptions of items or condition is based on a visual inspection only, and is not warranted. Bidders understand and accept that it is their responsibility to assess condition, value, or other pertinent factors in advance of bidding and that Auctioneer is not responsible for Bidder's assumptions made without directly contacting Auctioneer with questions and that all such sales are final. Items which are mechanical or powered in nature have not been tested unless otherwise noted, and their FUNCTIONALITY AND COMPLETENESS IS NOT WARRANTED. Condition descriptions of such items are VISUAL ONLY in nature, are not done by an expert in such equipment and do not constitute a warranty of running, complete or functional condition in any way. Bidder assumes all risk for the proper functioning, completeness and merchantability of items. Bidder understands that some items in this event have description details based on part numbers or tag information that may not be accurate. Auctioneer has attempted to describe such items as accurately as possible but such information is provided as a convenience to Bidder and is not warranted. Auctioneer is not liable for any injury, damage or loss incurred in connection with the sale, load out or any other pickup or activity related to the auction. Under no circumstances shall Bidder have any kind of claim against Auctioneer or anyone else for any failure of the bidding platform or failure of Auctioneer to receive or execute a bid. Auctioneer and his staff reserve the right to bid on items on their own behalf. Per Kentucky law we must charge sales tax unless you are a licensed reseller or items are shipped out of state by common carrier. We must have your sales tax ID number and certificate on file. There is a 3% convenience fee for payment by credit card. Certain items, specifically the real estate, fork lift, pallet racking as well as other items, may have additional special terms spelled out in their descriptions. It is Bidder's responsibility to fully read the descriptions and such terms prior to bidding. If Bidder leaves partial lots at pickup of items Bidder will be liable for a disposal fee for such items to be determined based on cost of removal. Pictures of items may show parts of other lots due to the nature of such items, see description to know what you are bidding on and buying and inquire with Auctioneer with any questions. Auctioneer is in no way responsible for Bidder's mistaken assumptions about what is included in a lot, and Bidder should contact Auctioneer with any questions prior to bidding. Removal of items is the responsibility of Bidder, and Bidder must bring all necessary tools, equipment and labor needed to properly and safely dismantle, move and load purchased items. Auctioneer will provide attempt to provide a fork lift with driver and pallet jacks for movement of items, but will not provide manual labor for such activities. Bidder and Bidder's staff must at all times observe all proper safety procedures while on premises. Storage is available past the pickup date for this event. Storage is billed at $25.00 per day per Bidder, and all items must be removed no later than Sunday April 8th. Storage is only available for fully paid items and storage must be paid at time of removal. Any items, paid or unpaid, are considered abandoned property and are forfeit after Sunday April 8th, no exceptions.
