TERMS & CONDITIONS FROM BEMIS CENTER FOR CONTEMPORARY ARTS GENERAL TERMS: There is no Buyers Premium added to all online bids. Online bidders must pay with either a VISA or MasterCard. All lots will be sold as is, where is. Due diligence regarding each lot is the sole responsibility of the buyers and bidders. All sales are final. No credit card charge-backs will be allowed. Purchases are available upon receipt of payment in full. We reserve the right to refuse service to anyone for any reason. All statements made the day of the sale take precedence over any previously written or verbal statements. The auction company is acting solely as a seller’s agent, and is not responsible for accidents, thefts, errors or omissions. Your final accepted bid is a binding legal agreement that you are liable for the cost of the services and goods on which you bid, and liable for that bid amount. TERMS: Bemis Center for Contemporary Arts has put forth every effort in preparing a digital catalog for this auction and to provide accurate descriptions of all items. All lots will be sold as is, where is. It is the bidder’s responsibility to determine exact details of any lot on which they want to bid. All printed or verbal descriptions by anyone associated with this auction are provided in good faith, but are only opinion. All comments made by the auctioneer the day of the live auction, should differences occur, supercede any and all verbal or printed comments made prior to that event. PAYMENT: All accounts must be settled at the conclusion of the auction. We accept American Express, Discover, VISA, MasterCard, PayPal only as forms of online bidding. A debit against your card will be made to Bemis Center for Contemporary Arts. Consult your tax advisor for deductibility status of any item you purchase. You will be charged for your purchases and any applicable taxes. Debit cards may show a hold on funds for a short period of time. It is the buyer’s responsibility to assure adequate credit available to the seller for the purchases made. Nothing will be charged to your card until a purchase is made. Each transaction necessary to collect insufficient funds will have a $25 fee imposed on the account. FOR PICKUPS: If you wish to pick up items you have purchased, please make arrangements one business day prior to pickup. You may do so by contacting Bemis Center for Contemporary Arts at (402) 341.7130. It is the buyer’s responsibility to check all contents of the package before removing it. The seller or the auction company will not be responsible for damaged or missing pieces once the package is in the possession of the bidder; i.e. “lost tickets, etc�. SHIPPING: Purchased items will be shipped through the Bax Global or Fedex, or the Bemis Center for Contemporary Arts can deliver within the Omaha/Lincoln area. All shipping, insurance and related charges are the responsibility of the buyer. You will see a separate charge on your credit card for the shipping costs. You will be notified the amount by the seller before the charge is made. LIVE INTERNET BIDDING: Bemis Center for Contemporary Arts conducts its auctions in a brisk fashion and we move quickly so we encourage that you bid quickly. You will be notified within 48 hours of the auction of your purchases via e-mail addresses required of you prior to your successful registration for the auction. REGISTRATION: All bidders must provide their name, address, phone number and e-mail address so we may be of full service to you. None of these details will be released to any other party by the auction firm or seller. UNPAID BALANCES: Should there occur an unpaid balance for some reason, the buyer agrees to pay all reasonable attorney fees and collection fees associated with the costs of collecting these balances. A charge of 2% of the purchase price will be added to unpaid balances on the first of each month following the auction. Any legal debt collection or dispute will be heard in Douglas County, Nebraska. LIVE ONLINE BIDDING: The auctioneer, and only the auctioneer, acting as sales agent for the seller, has the sole right to advance the bidding and may reject a nominal advance, should it be, in his opinion, injurious to the auction. The auctioneer is the sole and final authority in all bidding disputes and will name the final bidder as the purchaser. Once the statement “sold� is made, a legal contract has been formed between buyer and seller, and upon payment, the purchased lot is owned by the purchaser. By bidding on any item, the bidder acknowledges and shows acceptance of the terms of this auction. All sales are final. PREBIDDING: All items will be available to bid on beginning Oct 2. The online pre-bidding will occur through the live auction held on Saturday, November 14th at 8:00p.m. Prebids are accepted at www.proxibid.com/bemis. All prebids are subject to continuing online bidding during this live event as well as live auction bidding. The highest bid, regardless of source, will be declared by the auctioneer during the live auction event. The auctioneer solely has the discretion to determine the winning bid and will announce the winning bid at the conclusion of the live auction of each lot on November 14th. Again, to bid online, you must create an account through www.proxibid.com and it must be approved by Bemis Center for Contemporary Arts. RESERVE ITEMS: There are a small number of items with reserve (lowest possible dollar) prices on them. Bemis Center for Contemporary Arts reserves the right to “non-sell� these items during the live auction should this reserve price not be met.
