Auction Terms: By registering and participating in this auction, you, buyer, agrees to the following terms and conditions as well as any changes announced prior to the end of the auction.
General information: Amazing. The “Yum Buffet Chino” Will be sold. We have the opportunity to liquidate the entire contents, down to the bare walls of one of the most, if not (the most) elaborate, high end buffet restaurants our service has ever seen in its 20 plus years of service. K.E. Auction Service, along with our on line auction service contractor (Proxibid) is selling out everything, yes everything down to the drywall and studs. The place is several hundred square feet of dining and cooking use, and resale items. The history we know, is that it used to be a Hometown Buffet, and then was opened as what was called Yum Buffet. The Yum Buffet folks did some amazing remodel. Unfortunately they were only opened for around a year and had to close their doors? Many items inside are less than one year purchased. That’s where we come in. It will be our task to conduct a wall to wall auction in order to liquidate the entire business. (please check back often for more lots and items to be added, (when, and if there is determined to be other fixture or misc. items added.) I.E Marble tile, carpeting, marble fixture etc. other fixtures Things of this nature. We plan to list the marble buffet counter in sections in order to make it available to those who may wish to use as-is? , dismantle, cut, and or repurpose it? For any information or to be considered for a preview date. Please call K.E. Auction Man @ 213.944.5732. If you are in dire need for any measurement on certain items I. E walk-in coolers, stoves etc. we can do that on the preview day. I will only schedule a one day preview, a day or two before the auction ends. If we have a decent amount of buyers, who are interested in committing to a solid date. One day, no exceptions please.
Starting terms: The terms will be as such. It is a timed, on line auction starting now and ending on Saturday January 12th 2018 at 7:00 PM . Items will end every two minutes. Because this was an operational running business, not long ago. Several auction items are connected and, or attached (where applicable) for use. The buyer (on some items) will have to carefully and with the utmost safety, detach and uninstall certain items. Many items that were in use are still connected and will have to be disconnected by the buyer in order to take delivery. The walk-in coolers, water heaters, stoves, hoods should be removed and uninstalled by someone with a great knowledge of safety and service with these items. Of course many items are free standing and can just be pulled and loaded easily. If it is a kitchen item it will probably still need to be disconnected in some way. All uninstall and removal is the buyer’s responsibility. It is suggested that you contract a qualified person to remove some of the commercial items. The auctioneer and seller will not be responsible for accident or injury when conducting such task.

Major appliances, large kitchen items, and some fixtures can be picked up through the end of the week until Sunday January 20th by strict and convenient appointment though property management. You will be giving that information on first pick-up day, if your item or items qualify for appointment pick up. Appointment pick up will only apply to certain items or lots and will be determined by the auctioneer with he’s utmost professional discretion. All other should pick up on the first two pick up days no exceptions please.
In order to bid through online sources, (Proxibid) you must register online and provide a valid driver’s license as well as a valid credit card (Visa, MasterCard, Amex, Discover). Payment is due in full by first pick up day Monday January 14th 2018, if you do not pay by then your credit card will be charged the balance owed immediately.
A 15% for internet bidders buyers premium will be added to bid price plus sales tax (7.25% San Bernardino. County). If purchasing for resale you need to provide us with copy of resale permit on payment day. All items must be paid for in full prior to removal. Items not picked up by due time will be deemed abandoned and disposed of at the sellers discretion. The Auctioneer reserves the right to take sealed bids/phone bids, accept bids in any increment to the best interest of Sellers, and to reject the bidding from anyone whose conduct or actions are not in the best interest of Sellers. The Auctioneer and Sellers reserve the right to add or delete merchandise without prior notice. The catalog is prepared as a guide and we do not warrant the accuracy, description, age, measurements, count, etc. of any of the lots specified. Neither seller nor K. E. Auction Service will be responsible for any errors or omissions in the description of the merchandise. Everything is sold AS-IS, WHERE-IS and all sales are FINAL. Please preview picture before bidding, the picture are of the actual item being sold that you will receive. No refunds for any reason accepted.
Buyer acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to hold Auctioneers and Seller harmless from any and all damages, claims, liabilities from injuries to persons or property of any type whatsoever caused during the sale or during the removal of items purchased or afterwards, during the use of any of the purchased items. Buyer should do his/her own independent research prior to purchasing and buyer agrees that buyer is purchasing as is and any repairs/upgrades needed on these products are the sole responsibility of buyer. No returns will be accepted, no monetary credits will be given and buyer won't contest any credit card charges. K. E. Auction Service will only provide auction invoice. Absentee bids and web cast/live internet bidding are provided as a service to bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against seller, K. E. Auction Service, or anyone else if the internet service fails to work correctly before or during the timed auction. By participating at the auction, bidder warrants that bidder has the ability, capacity and authority to enter into an agreement to purchase the item and by being the successful bidder has entered into an irrevocable offer to purchase for the full amount of the bid plus buyers premium and sales tax. If any item is withdrawn from the auction after bidding has completed, the purchasers sole remedy shall be the refund of any purchase price actually paid. These Terms and Conditions, and all questions with respect to the interpretation of these Terms and Conditions, shall be governed by and construed in accordance with the internal laws of the State of California, without regard to conflict of law’s provisions. All bidders expressly consent to personal and exclusive jurisdiction in the courts of the State of California located in San Bernardino county . Buyer agrees to pay all of Auction Company’s attorneys fees arising from any claims to this agreement (regardless if there was a breach or not), and for any other actions disputing this contract. Everything is being sold as is where is without any guarantee. Buyers premium + sales tax will be added to all sales. Thank you for participating. Please bring copy of your invoice when your pickup or if you're sending a representative to pickup your purchases, they MUST have copied of your invoice along with a signed note from you authorizing a third party to pickup on your behalf. If requested, you agree to email us a copy of your driver's license along with copy of your credit card.
