Blue Earth Benefit Auctions may attempt to describe the merchandise in advertising, on the Internet and during the auction but makes no representations. In no event shall Blue Earth Benefit Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Buyer shall be the sole judge of value. It is the Buyer’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Blue Earth Benefit Auctions shall endeavor to describe in detail each item and any pertinent information about it. Blue Earth Benefit Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Buyer agrees that everything is sold as is and that they may not return any item they purchase. Blue Earth Benefit Auctions is allowing Buyer to participate in the auction through Internet bidding. Buyer acknowledges and understands that such services may or may not function correctly the day of the auction. Under no circumstances shall Buyer have any kind of claim against Blue Earth Benefit Auctions or anyone else if the Internet service fails to work correctly before or during the auction. Blue Earth Benefit Auctions will not be responsible for any missed bids from any source. Due to the complexity of modern electronics and digital photography it is often impossible to get an exact and consistent reproduction of the item. Blue Earth Benefit Auctions will not be responsible for any variation between the catalog image and the actual piece. Blue Earth Benefit Auctions may postpone or cancel the auction, withdraw any property from the auction, or change any terms of the auction or particular conditions of sale prior to the auction. Blue Earth Benefit Auctions reserves the right to withdraw or re-catalog items in this auction. All announcements made on the day of the sale supersede all printed material. If Blue Earth Benefit Auctions determines that any opening bid is not commensurate with the value of the article offered, Blue Earth Benefit Auctions may reject that opening bid and withdraw the article from sale; and, if having acknowledged an opening bid, Blue Earth Benefit Auctions decides that any advance thereafter is not of sufficient amount, Blue Earth Benefit Auctions may reject the advance. Certain items in the sale are may be offered subject to reserve, which is the confidential minimum price below which such lot will not be sold. Items may be offered with a “minimum bid“, in which case, Blue Earth Benefit Auctions agrees to sell the item to the highest bidder (Buyer) who bids at or above the minimum bid price. Buyer's premium is set by Blue Earth Benefit Auctions and will be added to the high bid to determine the total purchase price paid by the Buyer. A buyer's premium of 10% (Internet Buyer’s Premium) will be added on to the final bid price. Nebraska state sales tax of 7% may be applied to final bid amount, plus Internet Buyer’s Premium. Blue Earth Benefit Auctions will donate all proceeds from the Internet Buyer's Premium to the Nebraska Affiliate of Susan G. Komen for the Cure and Omaha Schools Foundation to benefit the Harrison Elementary School library. Donation will be made by Blue Earth Benefit Auctions on behalf of Blue Earth Benefit Auctions and Proxibid, Inc., in recognition of the Buyer and Emily Waldo. Once a Buyer has won the bid, ownership of the item immediately passes to the Buyer of the item. Buyer thereupon (a) assumes full risk and responsibility for the item, and (b) shall pay the full purchase price, including Nebraska State Sales Tax, buyer’s premiums and shipping charges. Delivery of the purchased items is the responsibility of the Buyer unless shipping is offered by Blue Earth Benefit Auctions. Please read shipping instructions stated for each auction for more information. Buyer must submit payment to Blue Earth Benefit Auctions for all purchased items within twenty-four (24) hours following receipt of an invoice and before removal of any items from the auction. These Default Auction Terms shall constitute a legally binding contract between Buyer and Blue Earth Benefit Auctions, which contract shall be construed and enforced in accordance with the laws of the State of Nebraska in which Blue Earth Benefit Auctions is located, without giving effect to the conflicts of laws principles of such state. In the event of any conflict or inconsistency between these Default Auction Terms and any Special Terms of Sale and Proxibid’s Unified User Agreement, the Special Terms of Sale shall prevail and govern.
