1. Schrader Real Estate and Auction Co., Inc. (the auction company) has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold 'as-is' and it is the bidder's responsibility to determine the exact condition of each item. 4. If your bid is accepted as the winning bid for a particular lot, that lot shall immediately become your responsibility. Your responsibility includes: (i) the cost of insurance and the risk of loss or damage to such lot; (ii) the payment of applicable charges with respect to the lot; and (iii) all shipping/handling costs, including preparation, shipping and insurance. However, you will not be entitled to take possession or control of any lot until you have made payment in full for all lots purchased by you. You agree to compensate Schrader and/or Seller for any storage, hauling charges or damages suffered by Schrader's and/or Seller because of your failure to timely pay for any purchased lots and /or your failure to remove any purchased lots within the removal period specified by Schrader for the Auction.
5. Our on-line auctions move quickly! If you are interested in an item, bid quickly or use the pre-bid format. If you win an item in the auction you will be invoiced/notified by email. At The Conclusion of the Auction
6. All bidders must provide their name, address, daytime phone number, an alternate phone number and email address at which they can be contacted.
7. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Whitley County, Indiana.
8. SCHRADER CANNOT AND DOES NOT GUARANTEE THAT BIDS PLACED VIA ONLINE BIDDING SERVICES WILL BE TRANSMITTED TO OR RECEIVED BY THE AUCTIONEEER AND/OR THE AUCTION SOFTWARE PROVIDER IN A TIMELY FASHION.
9. The conduct of the auction and increments of bidding are at the direction and discretion of the Auctioneer. The Auctioneer has the right to preclude any person from bidding and/or to reject any bid if there is any questions as to: (i) the credentials of the person attempting to bid; (ii) whether the bid is made in good faith; and/or (iii) whether the bid is otherwise made in accordance with all applicable laws, terms, conditions and restrictions. All decisions of the Auctioneer are final.
10. The auction company shall not be held responsible for any 'missed' bids or bids unseen by the auctioneer.
11. All sales are final.
12. By bidding on any item, the bidder shows acceptance of the terms of the auction. Please Preview Pictures carefully as they are part of the lot description . The auction company reserves the right to refuse service to any person.
14. All announcements made day of auction take precedence over any and all written or verbal statements.
15. Pick Up/ Items MUST be removed from the sale site by 5 pm, EST,Wednesday January 10th. Or at Schrader Office by 5 p.m. Close of Business Wednesday January 10th unless prior arrangements are agreed upon, or the Seller has the right to retain respective items and void the purchase.
