This AUCTION REGISTRATION AND BIDDING AND SALES AGREEMENT (the Agreement) is entered into between the Bidder/Buyer(the Bidder/Buyer) as signed below and H. Barry Smith Realtors and Auctioneers, LLC (the Auctioneer). The Bidder/Buyer agrees that the terms listed below shall govern the auction and sale and he/she agrees to be bound by them. Additional terms may be posted or announced from the auction block which are just as binding as the terms set forth below. All items are sold “AS IS WHERE IS” and “WITH ALL FAULTS” and the Auctioneer and the seller and/or owner of each item expressly disclaims any warranties. By bidding, the Bidder/Buyer acknowledges that he/she has inspected the property that he/she is bidding on and accepts it as such. All information contained herein is true and correct to the best of our knowledge but is in no way guaranteed as to the accuracy of the description made, model, year, conditions, etc. All bids are final. The Auctioneer has the sole discretion and final authority to recognize the winning bidder. The Auctioneer reserves the right to re-open bidding if he determines there was a “tie bid.” Kentucky State Sales Tax will be charged on all items unless the Bidder/Buyer has a valid resale certificate. Purchasers with a resale certificate must provide their Sales Tax Exemption Number. Failure to do this will require payment of sales tax on all purchases. All announcements made on the day of the Auction will take precedence over any printed material. A 13% Buyers Premium will be added to all winning bids to determine the final purchase price. A 6% sales tax will be added to items purchased and shipped in Kentucky. Remember, nothing is perfect, including some of these pieces as well as my descriptions, however, condition, size and descriptions are as accurate as possible. No returns or cancellation of purchases is permitted.
