Special Terms
A deposit of Five Thousand Dollars ($5,000.00) is required from each bidder on each property offered. This deposit must be received by Meares Land & Auction Company six hours prior to the auction, or by 9 am EDT on Thursday, April 28, 2005. This deposit can be sent to Meares Land & Auction Company, 315 Eastview Rd., Pelzer, SC, 29669-9714 in the form of a Cashier’s Check or wire transferred to auctioneers account. The property is being offered subject to approval of final bid by the seller of each lot, and when the final bid is approved, a Ten Percent (10%) Auction Fee will be added to arrive at the Contract Price. At this time, a Real Estate Offer to Purchase Contract will be e-mailed you for your signature. This contract must be signed and faxed back to MLAC within 30 minutes. The balance of the Contract Price must be paid within 30 days following the auction. Real Estate closings that do not occur within that time frame will cause the earnest money deposit to be forfeited by the purchaser. If a clear title cannot be issued for the property, the earnest money will be refunded. In any case, if you are not the successful bidder, the earnest money deposit will be returned to you within 5 days following the auction in the same manner in which it was received.
We can offer a list of closing attorneys in the area if you desire to use them for closing. The sellers will pay for the preparation of the deed of each lot, the pro-rata share of the property taxes on each lot, and any outstanding liens on each lot, if any. All other costs of the closing transaction, the revenue stamps on the deeds, and any surveys required by a lending institution will be paid by the purchaser of each lot.
Since these lots are offered on the internet, you should visit the properties if possible, or have an agent visit them for you. We will assume no responsibility for lots purchased that are later deemed unsuitable for your use, or for any other reason.
