Prior to bidding, please read our terms and conditions detailed below in their entirety. AmeriWestAuctions, LLC requires each and every bidder to accept the terms and conditions of the sale in their entirety and by bidding, every bidder thereby agrees that they have accepted the terms and conditions of the auction in their entirety.
1. All property is SOLD AS IS, where is and without recourse of any nature, and AmeriWestAuctions, LLC makes no representation or warranties, express or implied, with respect to size, count, weight, style, authenticity, provenance, period material, origin copyright or reproduction right or any other warranty except as specified in the description on any lot sold. All measurements are close but approximate and lots are photographed next to a ruler for buyer inspection and verification.
2. AmeriWestAuctions, LLC is not responsible for damage after purchase, regardless of cause. Although it is believed that every item in this auction is authentic, AmeriWestAuctions, LLC does not guarantee the authenticity of any lot in this auction as the authentication of many Native American Artifacts leaves much for interpretation. We are not responsible for any typographical errors of descriptions. The item descriptions and actual recent photos are meant to serve as a guide only.
3. AmeriWestAuctions, LLC encourages all potential bidders do their due diligence.
4. All sales are final. No returns. No exceptions.
5. AmeriwestAuctions, LLC is not responsible for internet bidding errors and is not responsible for errors made while bidding via electronic medium.
6. All lots are sold to the highest bidder. If any dispute arises after a sale, AmeriWestAuctions', LLC sale record shall be conclusive.
7. Absentee bids may be placed by mail, email, phone or in person. AmeriWestAuctions, LLC will execute such bids on behalf of the bidder, up to the maximum amount specified. Absentee bidders must have credit card information on file to bid. AmeriWestAuctions, LLC is not responsible for errors or omissions in the execution of these bids.
8. A Buyer's Premium amount of 23% will be added to the high price of each lot sold. The purchase price payable by the buyer shall be the sum of the final bid plus the buyer's premium and shall be paid to AmeriWestAuctions, LLC within 3 days of the closing time of the auction.
9. Total Payment is due within 3 days of the closing time of auction. Payment may be made over the phone, or in person, by check, cash, Visa, MasterCard, PayPal or American Express. Payment can be made via our website at AmeriWestAuctions.com
10. No auction lot may be removed during the auction or at any time until the full purchase price has been paid. All lots must be removed within 7 days after the auction at the Purchaser's expense or they will be assessed a storage fee of $10.00 per lot, per day with a 7 day maximum storage fee. On the 8th day, if any item has not been picked up by the purchaser or shipping company, the item(s) will be considered forfeited to AmeriWestAuctions, LLC. 11.AmeriWestAuctions, LLC will not be held responsible for loss or damage to items after purchase by buyers. AmeriWestAuctions, LLC reserves the right to re-auction, without reserve, items not removed or not paid for as indicated herein.
12. Returned checks are subject to a $50.00 service charge.
13. International buyers: It is the buyer's responsibility to check the relevant import and custom regulations prior to bidding.
14. AmeriWestAuctions, LLC will provide Purchasers with a list of recommended shippers available on our site. If for any reason a purchased lot is stolen or lost prior to delivery/pick-up, AmeriWestAuctions, LLC shall not be liable for any amount in excess of that paid by the purchaser. We are not responsible for the acts of omissions of carriers or packers of purchased lots, whether or not recommended by us.
15. Auction items are not available for pick up until after the purchaser receives an invoice and the lot is paid for in full.
16. All invoices, documents, contracts and conditions are governed by the laws and judicial system of the State of Missouri, County of Greene.
