WARRANTY: All items sold “As Is, Where Is!” The Auctioneer assumes no liability for any guarantee made by the seller. No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any property sold. It is agreed that the buyers have thoroughly examined the property to be conveyed and relies solely upon his/her own judgment in making an agreement to purchase, and that there are no agreements, understandings or representations made either by seller, Auctioneer or Auctioneer’s representatives that are not set forth herein. We attempt to describe the items to the best of our ability as they are presented to us by the seller. DISPUTES BETWEEN BUYERS: The Auctioneer shall designate the purchaser after each item of merchandise is sold. If a dispute arises between two or more buyers, the Auctioneer reserves the right to reopen bidding. His designation of a buyer shall be final. RESALE: Auctioneer reserves the right to resell any property not paid for in full on day of sale. The buyer shall be responsible to Auctioneer for any expenses for resale or collections and any damages resulting from sale. INJURY & DAMAGES: Bidder acknowledges responsibility for and assumes liability for any personal injury and property damage caused by bidder or his agent and further agrees to hold Auctioneer harmless for any personal injury to himself or his agents and any property damage incurred on sale premises. SALES TAX, PURCHASES BY DEALER FOR RESALE, ETC.: All sales are subject to sales tax laws of the State in which auction is held. It will be necessary on sale day to execute a Certificate of Resale for all purchases to be resold. This certificate must bear your sales tax permit number. Failure to furnish this information will require payment of sales tax on all purchases. You will be notified at the end of Auction via email with your settlement sheet noting all purchases and amount due. This invoice will serve as the billing amount that is charged to your credit card on file. Any bidders with credit cards that are declined on reconciliation day will be charged a $30 processing fee to run another credit card- NO EXCEPTIONS! If you disagree with the terms of the sale and/or shipping - and file a request to be refunded for the cost and issue a charge back - you will be placed on the banned list, charged $30 processing fee, and your account will be turned over to collections. You agree on bidding to the terms of this contract, and shall be responsible for all costs related to the item once you are the new owner.
