TERMS AND CONDITIONS OF THE SALE
Conditions of sale: Bids will be accepted online only through Proxibid and will be on a per acre basis using a nominal acreage of 460. This will be a timed auction and bids will be accepted until closing of the auction. A sample contract is available upon request. Please contact Coxj@obu.edu. Closing will take place on or before 30 days following the execution of the sales contract at the office of Lenders Title company Bryant Arkansas. Title will be conveyed free and clear of all liens and encumbrances. Acreages are believed to be correct but subject to survey. Survey is to be provided by seller. If purchaser wishes to have lines painted, then it shall be at purchasers expense. AN 11% BUYERS PREMIUM WILL BE ADDED TO THE WINNING BID TO ARRIVE AT THE FINAL PURCHASE PRICE. Buyer shall deposit 10% of the FINAL PURCHASE PRICE as non-refundable earnest money upon execution of the sales contract. Total payment of final purchase price will be due at closing.

Seller reserves the right to accept any bid or reject all bids. Seller does not believe they own any mineral rights however, seller shall convey without warranty any and all mineral rights they may own. Seller will furnish at sellers cost a standard owners policy of title insurance in the amount of the purchase price. Title search fees associated with said title policy will be paid by the seller. The seller will pay for deed preparations and 1/2 of expenses of closing agency fee and 1/2 of deed stamps. BUYER will be responsible for deed recording fee and 1/2 of expenses of closing agency fee and 1/2 of deed stamps. Any additional closing costs above those costs will be paid by the buyer. Property taxes will be prorated and paid by the seller up to the closing date.
Perspective buyers have the right to enter unto the property for the purpose of interior inspection. Perspective buyers must call John Cox at 1(501)617-1759 for combinations of gate locks. Property interior inspection shall be conducted during daylight hours prior to bid close date. Perspective buyers and their agents understand and acknowledge that while on the property they assume all liability and shall indemnify seller and its agents from and against all claims, demands, or causes of actions of every kind, nature and descriptions relating to access to or presence on the property.
Any personal property items such as hunting blinds, game feeders, or cabin furnishings do not convey with the property.

Located in Saline county, Arkansas containing 460+/- acres. This property is being offered through a per acre online bid sale. The tract is located approximately 23 miles from the “Big Rock” intersection of highway 630 and 430 in southwest Little Rock. Great potential timberland, recreational, and development opportunity. Primarily used for the last 8 years as a family hunting preserve. Last seasons harvest yielded 10 deer. Includes 1800 Sq/Ft heated and cooled, two full bath Lodge. Property consists of primarily timberland pine plantations varying in ages form 0-45 years old with some natural growth hard woods. Natural creek runs through the property with two beaver ponds. Property is gated for limited access. Southern boundary of the property is 1/2 mile of a paved county road (Sardis-West Miller Rd) with a main waterline along the right of way.

Disclosures: The real property will be offered for sale and conveyed subject to all conditions, covenants, deeds, easements, reservations, restrictions, right-of- ways, title exceptions, and matters of record.
Real Property Sale Contract: This is a cash sale and not contingent upon any matter, including Buyer obtaining financing. Buyer shall immediately execute the Sale Contract and all related documents presented by the Auctioneer to bind Buyer and Seller to the sale of the Property. An eleven-percent (11.00%) buyer’s premium shall be in effect for the auction and added to the amount of the highest bid to arrive at the selling price (total contract price) for the Property. Buyer shall execute the Sale Contract and no addition, deletion, or revision shall be permitted. The “Terms of the Auction” are incorporated into the Sale Contract which defines the entire agreement between Seller and Buyer. The Terms of the Auction complement the Sale Contract, and in the event of any conflict between them, the Sale Contract shall control in all instances.
Earnest Money Deposit: A %10 earnest money deposit will be required at the time of execution of the contract. The balance will be due at the closing on or before 30 days from the date of the auction. If for any reason Buyer fails to timely execute the Sale Contract or pay the deposit, Seller has sole discretion, to pursue all legal and equitable remedies available against Buyer or declare Buyer’s bid to be immediately forfeited, null, and void, without any requirement of notice, and immediately re-sell the Property to another Buyer.
Jurisdiction and Venue: The exclusive jurisdiction and venue for any controversy or claim between the parties shall be the county of Saline in the State of Arkansas.
