Proxi payments are due no later than Friday AM or NON PAYING bidder goes into effect. Shipping charges will be Charged for the exact shipping, insurance and materials separately on your card.e. Local pickup is available starting on Tuesday after the auction. Material fees are $5 for small lots and $10 for larger lots, firearms and multiple item groupings. All firearms have to be shipped in hard cases to prevent damage in shipping. Large hard gun cases are $30 ea. Handgun hard cases are $15. Customer may ship cases back to us for a full refund of the case charge. Large antique weapons that don't fit a normal gun box, will be charged extra for oversize. All items left on hold due to buyer not providing proper information or FFL info needed for shipping, will be resold after 30 days and commission will be charged. All UPS damage claims have to go thru us and items need to be returned and inspected by UPS. Photos need to be sent immediately prior to us filing a claim for any damaged merchandise. Buyers must co operate with us in order to process the claim. Buyers refusing to send items back or disputing credit card after receiving merchandise will be held as a fraudulent transaction are charged with possession of stolen property. All auction transactions are sold AS IS and NO REFUNDS.

All Firearms are sold as collectible. We expressly disclaim any warranty concerning the condition, functioning or safety of any firearm offered for sale. California FFL dealers must have copies of their licenses and dealer number to be able to obtain firearms. Out of state dealers will have to supply necessary FFL paperwork. Individual buyers will have to abide by all Federal and State laws to obtain purchased firearms. BUYERS WHO DO NOT OR CANNOT TAKE POSSESSION OF THE ITEMS THEY PURCHASE: If a bidder is unable to receive an item purchased because he is denied transfer of a transfer under legal restriction, or is unable to successfully arrange export or import of an international purchase, or for any other reason not solely Past & Present Collectibles' fault, the buyer is still responsible for payment in full to Past & Present Collectibles for the gavel price plus applicable buyer's premium & additional expenses. The buyer may request shipment at the buyer's expense to an FFL dealer to resell a gun on the buyer's behalf. If buyer does not notify Past & Present Collectibles of such arrangements within 10 days of the auction date, Past & Present Collectibles may resell the lot at a future auction, charging the buyer the current standard seller's commission for doing so.
In the event a dispute arises, related in any manner to the auction or the property purchased, buyer agrees with us to submit the dispute to final and binding arbitration in the City of El Cajon, San Diego County, California. No party shall be entitled to attorneys' fees or costs. Our liability shall be limited to the total of the bid price, buyer's premium, sales or use taxes and, if applicable, license or transfer fees.
