Auction Terms & Conditions
Buyer's Premium
A 10% buyer's premium will be added to all purchases made through Proxibid.
The buyer's premium is calculated based on the final bid price.
Payment
Accepted forms of payment include cash, check, wire transfer, or credit/debit card. An additional
4% convenience fee will be charged for all payments made by credit or debit card.
Payment must be made by Tuesday, September 8th, at 5:00 PM, and before the removal of
any purchased items. Buyers will be required to present a paid invoice before removing any
purchases. If someone else is picking up your items, they must present a paid invoice before
any items will be released.
Failure to make payment by the stated deadline may result in cancellation of the purchase,
resale of the item, suspension of bidding privileges, and the buyer being held responsible for
any resulting deficiency, collection costs, or other damages allowed by law.
Item Location
Unless otherwise indicated, all items are located at our auction facility at 5701 Alma Highway,
Van Buren, Arkansas. Any items located off-site will be clearly identified within the individual lot
description.
Sales Tax
Applicable Arkansas sales tax will be collected unless the buyer provides a valid resale
certificate or other acceptable sales tax exemption documentation prior to payment.
Preview & Inspection
Preview of all items is strongly encouraged and will begin on August 17th and continue until the
auction date. Buyers wishing to inspect items prior to August 17th should contact our office at
479-996-4848 to schedule an appointment.
It is the bidder's sole responsibility to inspect all items and determine the age, condition,
authenticity, value, and suitability of each item prior to bidding. By placing a bid, the bidder
acknowledges they have either personally inspected the item or voluntarily waived their
opportunity to do so.
Condition of Items
ALL ITEMS SELL AS-IS, WHERE-IS, WITH ALL FAULTS.
Looper Auction & Realty II, LLC has attempted to describe all items as accurately as possible;
however, no warranty or guarantee, expressed or implied, is made regarding the condition, age,
year, make, model, serial number, hours, mileage, authenticity, merchantability, fitness for a
particular purpose, or performance of any item.
Any photographs, videos, descriptions, condition reports, meter readings, or verbal statements
are provided solely as a courtesy and are believed to be accurate but are not guaranteed.
Buyers are strongly encouraged to inspect all items before bidding.
Announcements made by the auctioneer on auction day shall take precedence over all printed
material, online listings, advertisements, and prior verbal statements.
Internet Bidding
Looper Auction & Realty II, LLC is not responsible for missed bids, delays, internet outages,
platform malfunctions, software issues, or other technical difficulties beyond our control that may
interfere with a bidder's ability to participate.
Removal of Items
No items may be removed until payment has been received in full.
Buyers are solely responsible for loading, securing, transporting, and removing their purchases.
Any loading assistance provided by Looper Auction & Realty II, LLC is offered as a courtesy
only. Looper Auction & Realty II, LLC assumes no responsibility or liability for damage to
purchased items, vehicles, trailers, or personal injury occurring during loading or removal.
Risk of loss passes to the buyer immediately upon being declared the successful bidder.
Items remaining on-site more than 21 days following the auction date will be considered
abandoned and will be subject to a storage fee of $25.00 per day.
Items remaining on-site until our next quarterly auction may, at the sole discretion of Looper
Auction & Realty II, LLC, be sold without reserve. Any storage fees, selling expenses, and other
applicable charges will be deducted from the sale proceeds before any remaining balance is
remitted to the original purchaser.
Titles
If you purchase a titled item, the title will generally be processed and mailed within 30?45 days
after payment has cleared, unless otherwise stated in the lot description. Titles will be mailed to
the address provided during bidder registration. Buyers are encouraged to carefully read each
lot description for any title-related information prior to bidding.
Auctioneer's Rights
Looper Auction & Realty II, LLC reserves the right to refuse any bid, resolve any disputed bid,
withdraw, regroup, or divide lots, correct clerical or typographical errors, and make
announcements or modifications to the auction whenever deemed necessary.
This auction permits bids to be placed by the auctioneer, an employee of the auctioneer, the
seller, or an agent acting on the seller's behalf, in accordance with UCC ? 2-328.
