NOTICE
By registering to bid, placing a bid, or participating in this auction, each bidder acknowledges that they have read, understand, and agree to be bound by these Terms & Conditions. Placing a bid constitutes acceptance of these terms.
CHECK OUT & ITEM PICKUP
Buyers may begin removing purchases after the auction concludes. Loading will not take place while the auction is in progress. All items must be removed no later than Friday, September 4, 2026 at 4:00 PM CDT.
A telehandler will be available on-site to assist with loading through the removal deadline (Friday, September 4, 2026 at 4:00 PM CDT). After that, buyers are responsible for making their own loading and removal arrangements.
For safety, loading is conducted during daylight hours only and is weather permitting. Loading will continue until shortly before dark, or longer when conditions remain safe, at the sole discretion of Heartland Machinery Auctions. Loading will not be performed after dark or in unsafe weather conditions.
Items not removed by the deadline are subject to a storage fee of $25 per item, per day. Removal is at the buyer's expense and risk. No loading dock on-site.

AUCTION FORMAT
This is a **Live Onsite & Online Simulcast Auction**.
Bidders may participate:
* In person at the auction site
* Online through approved bidding platforms
The Auctioneer acts solely as agent for the seller(s).
The Auctioneer reserves the right to:
* Reject any bid
* Deny or revoke bidding privileges
* Remove any lot from the auction
* Re-offer or reopen bidding in the event of a dispute
* Pause, delay, or cancel bidding due to internet interruptions, technical issues, or other unforeseen circumstances
The Auctioneer's record of sale shall be final in all disputes.

BUYER'S PREMIUM
A Buyer's Premium will be added to all successful bids as follows:
* **10%** on the first **$50,000**
* **3%** on any amount exceeding **$50,000**
Examples:

PARTICIPATION REQUIREMENTS
A valid credit card is required to register.
The Auctioneer reserves the right to request identification, proof of funds, business information, or additional verification before approving or maintaining bidding privileges.

PAYMENT TERMS
Payment is due **within three (3) business days** following the conclusion of the auction.
Accepted payment methods include:
* Bank Wire Transfer (Preferred)
* Certified Check
* Money Order
* Business or Personal Check (only with a current bank letter guaranteeing funds)
* Credit Card (Invoices up to **$1,000** only)
Credit card payments are subject to a **4% processing fee.**
Invoices exceeding **$1,000** must be paid by wire transfer or certified funds.
No equipment will be released until payment has been received and fully cleared.
Personal and business checks may require up to seven (7) business days to clear.
**No exceptions.**

DEFAULT & NON-PAYMENT
If payment is not received within the required timeframe, Heartland Machinery Auctions reserves the right to:
* Charge the credit card on file
* Cancel the sale
* Resell the item
* Ban the bidder from future auctions
* Pursue legal action
* Recover attorney fees, court costs, and collection expenses
* Hold the bidder responsible for any loss resulting from resale
Any chargeback on a valid purchase will be disputed to the fullest extent permitted by law.

SALES TAX
Nebraska and Iowa sales tax will be collected where applicable.
Sales tax is determined by the jurisdiction where the equipment is located.
Buyers claiming exemption must provide all required exemption documentation prior to payment, including but not limited to:
* Nebraska Form 13
* Iowa Form 31-014
* Other applicable resale certificates

ITEM LOCATIONS
**IMPORTANT**
**Not all equipment is located at the Sarpy County Fairgrounds.**
Many items will be selling **directly from consignor locations throughout Nebraska, Iowa, and surrounding states.**
Each lot clearly identifies its location.
**It is the bidder's responsibility to review each item's location before placing a bid.**
Please do not assume an item is located in Springfield simply because it appears in this auction.
After payment has cleared, buyers will receive complete pickup instructions, including the seller's contact information when applicable.
Heartland Machinery Auctions does not provide shipping services.
Buyers are solely responsible for transportation, freight, loading, insurance, permits, and pickup arrangements.

INSPECTION
Equipment may be inspected during the advertised preview period at the auction site or by appointment with the consignor for offsite equipment.
Please refer to each individual lot for inspection availability.

# REMOVAL
Unless otherwise stated in the lot description, purchased items must be removed within the time period specified by Heartland Machinery Auctions or the seller.
Items remaining after the designated removal deadline may be subject to:
* Storage fees
* Relocation charges
* Abandonment procedures
* Additional handling fees
Removal is solely at the buyer's expense and risk.
Neither the Auctioneer nor Seller assumes responsibility for accidents, damage, theft, delays, or injuries occurring during removal or transportation.

TITLED ITEMS
Titles will be mailed via UPS or another recognized carrier with tracking.
Please allow up to **30 business days** for title processing.
Items sold without title will clearly state **"No Title"** in the description.

All property is sold **AS IS, WHERE IS, WITH ALL FAULTS.**
No warranty or guarantee of any kind is expressed or implied.
Neither the Seller nor Heartland Machinery Auctions guarantees:
* Accuracy of descriptions
* Hours
* Mileage
* Model year
* Serial numbers
* Condition
* Functionality
* Merchantability
* Fitness for any particular purpose
Catalog descriptions, photographs, videos, advertisements, and statements made by auction personnel are provided solely as a guide.
Buyers are responsible for conducting their own inspections and due diligence.
All sales are final.
No refunds.
No exchanges.
No returns.
Risk of loss transfers to the purchaser immediately upon being declared the successful bidder.

ANNOUNCEMENTS
Any announcements made by the Auctioneer on auction day take precedence over all printed, online, catalog, advertising, or previously published material.

GOVERNING LAW
These Terms & Conditions shall be governed by the laws of the State of Nebraska.
Any legal action arising from this auction shall be brought exclusively in the appropriate courts located within the State of Nebraska.

BID RETRACTIONS
All bids are final.
Once a bid has been placed, it **cannot be retracted, withdrawn, or canceled**.
Bidders are solely responsible for all bids placed under their account, whether placed by themselves or by any person using their login credentials.
If a bidder is the successful high bidder, they are legally obligated to complete the purchase in accordance with these Terms & Conditions.
