European Pinfire Shotgun And Carbine Cartridge Lot

A representative group of early European pinfire sporting cartridges illustrating the development of pinfire ignition in shotgun and carbine applications during the mid-19th century. The lot includes a 16 gauge pinfire shot shell fitted with a solid lead slug, a 12 gauge pinfire shot shell attributed to Eley Bros. dated 1861 (empty), a large 10 gauge pinfire shotgun cartridge by C.D. Leet (also empty), and an 11mm pinfire carbine cartridge of French pattern. 

These cartridges reflect the transitional period in ammunition development following the introduction of the pinfire system by Casimir Lefaucheux in the 1830s, which saw widespread sporting and limited military use across Europe and, to a lesser extent, the United States. The Eley Bros. example is particularly illustrative of early commercial production of pinfire ammunition by one of Britain’s most prominent cartridge makers.

By registering to bid or placing a bid, you agree to all the terms outlined below. This forms a legally binding contract between you, Bannerman Auctions LLC, and the seller. 1. Registration, Contract, and Liability Binding Agreement: Completing our online registration confirms you have read, understood, and agreed to these Conditions of Sale and the Terms of Guarantee. Agency: Bannerman Auctions LLC acts as an agent for the seller (consignor). The final purchase contract is between the seller and you, the buyer. Guaranteed Payment & Default: As the registered bidder, you are personally responsible for payment of any successful bid, even if another person bids on your behalf (in-person, phone, internet, third party bidding platform, or absentee bid). If you default on payment or your high bid is removed, you are liable for any difference in the final sale price if the item sells for less than your original high bid. 2. Condition of Property: No Warranties: All Sales Are Final.Neither Bannerman nor the seller provides any warranties, express or implied, regarding the property, except for the limited guarantees of authenticity detailed in the 'Terms of Guarantee' section. Your Inspection Duty: It is entirely the buyer's responsibility to inspect items and rely on their own judgment regarding the item's condition and description. Catalogue Descriptions Are Opinions: Any statements made by Bannerman (in reports, ads, or verbally) regarding physical condition, size, quality, attribution, or historical significance are statements of opinion only and should not be treated as fact. Condition Reports: The absence of a condition note does not mean the lot is in perfect condition. Listing specific defects does not imply the absence of others. Any reference to damage or restoration is for guidance only. Additional details or information (photos, video, etc.) may be provided upon request with at least 48 hours advance notice prior to the auction closing. No Copyright Transfer: Purchasing a lot does not transfer any copyright or reproduction rights to you. Bannerman retains the copyright to all images and written material it produces for the auction. 3. Bidding Process, Reserves, and Estimates Bidding Rules Auctioneer's Discretion: The auctioneer has the sole right to refuse any bid, advance the bidding, withdraw, re-sequence, re-catalog, divide, or combine lots at any time for any reason. Highest Bidder Wins: Your bid is your offer to buy a lot at that price. If the auctioneer acknowledges your bid as the highest, it is accepted, and you are immediately contractually bound to purchase the item under these terms. The highest bidder acknowledged by the auctioneer is the purchaser. Disputes: In the event of an error or dispute, the auctioneer has the final discretion to resolve the issue. Bannerman's sale record is conclusive. Non-Present Bidders: We execute absentee or phone bids as a convenience and are not responsible for any error or failure in providing these services. We cannot guarantee we can facilitate last-minute bid requests (phone or email) received on the day of the auction. It is the sole responsibility of the buyer to cover all shipping, freight, and insurance costs, regardless of expense. Shipping Process: Shipping will be billed and collected separately. We do not accept customer-provided shipping labels. Most auctions ship within 2 weeks, but larger auctions may take up to 3 weeks. Unpaid Shipping: If your shipping fees remain unpaid in excess of 24 hours after packing, your card on file may be automatically charged and the item shipped. If shipping has not been arranged and paid 30 days following the auction, your items may be forfeited to the auction house to be relisted, disposed of, or donated at the buyer?s expense. Damage/Loss Claims: Any issues with delivery must be reported to the auction house within five business days after delivery. You must retain the packaging and supply photographs for any insurance claims. International Shipments & Restrictions: International buyers are responsible for customs fees and duties. We will not alter customs declarations to reflect a price lower than the true purchase price. Lots containing materials from endangered or protected species (e.g., ivory, coral, tortoiseshell) or prohibited items may require licenses or certificates for export from the U.S. or for import into other states or countries. We will not ship restricted materials (like ivory or baleen) outside of the United States. International buyers of these items must arrange for pick-up or delivery within the U.S. We will not violate any federal or country-specific laws to make a shipment. If a legal restriction prevents shipping, your item may be forfeited to the auction house to be relisted, disposed of, or donated at the buyer?s expense. You are responsible for the on-time payment of the full purchase price, even if obtaining any required license is denied or delayed. Firearm and Ammunition Shipments: Must be shipped to a Federal Firearms License (FFL) holder, with a copy of the FFL provided by the buyer. The buyer is responsible for all associated fees (shipping, handling, and FFL transfer fees). This excludes black powder and antique firearms (pre-1898), unless state or local laws require shipment to an FFL holder. The buyer is responsible for determining prior to bidding if there are any local restrictions on shipping or ownership of the item. The buyer is responsible for the on-time payment of the full purchase price, even if obtaining any required license or transfer is denied or delayed. 6. Remedies for Non-Payment and Abandonment If a purchaser fails to comply with any conditions, Bannerman (and the seller) may exercise one or more of the following remedies: Late Payment Fee: A late charge of $1.5% per month (18% per annum) on the total purchase price may be imposed. Storage Fees: If property is not removed within 30 business days, Bannerman may charge a storage fee of $25 per lot or 5% of the purchase price per lot (whichever is higher) per month. Abandonment: If the invoice and storage fees are not paid in full after 90 days, the property will be considered abandoned, and no refunds will be given. Resale and Deficiency: Resell the property publicly or privately. The original purchaser will be liable for any deficiency between the original price and the resale price, plus all associated costs. Cancellation and Forfeiture: Cancel the sale and retain all payments made as liquidated damages. Legal Action, Set-off, and Bid Rejection: Commence legal proceedings, apply amounts Bannerman owes the buyer against the debt (set-off), and/or reject future bids. 7. Limited Liability and Other Provisions Shipping Liability: Bannerman is not responsible for the acts or omissions of third-party carriers or packers. Total Liability Limit: If a lot is lost, stolen, or damaged, Bannerman's liability will not exceed the amount you paid for the lot. Anti-Money Laundering (AML): Bannerman may, at its discretion, refuse your participation or cancel your bid at any time to verify your identity and the legality of funds to protect against money laundering. Governing Law: These terms are governed by the laws of the State of Missouri. By bidding, you consent to the jurisdiction of the courts in Missouri. Terms of Guarantee: Authenticity and Returns We specialize in vintage and historical objects. Items are sold with their faults, imperfections, and signs of age, we cannot account for every flaw. Due Diligence: It remains the buyer's responsibility to inspect items and rely on their own judgment regarding the item's condition and description. Limited Guarantee and Refund Policy Refund Eligibility: If an item is proven to be misidentified, misrepresented, or a deliberate forgery, the original buyer may return it within 90 days of the sale date for a refund of the purchase price only, provided the item is in the same condition as sold. Refunds will NOT be given if: The original description aligned with accepted expert opinion at the time of sale. Proving the item was a forgery required scientific methods that were impractical, expensive, or unavailable when the catalog was published. Limitations: Any claim is limited to the amount you paid for the lot, excluding shipping; we will not cover any other damages or expenses. The right to a refund belongs only to the person whose name is on the original invoice. Bannerman Auctions LLC must be notified within 90 days of the date of sale of the discrepancy. NO refunds will be given after 90 days of the date of sale for any reason. Historical Artifacts No Guarantee of Serviceability: Bannerman Auctions does not condone the consumptive use of historical artifacts. Returns will not be accepted because an artifact's age has made it unsuitable for its original service purpose (e.g., vintage garments are not guaranteed to fit or be wearable).
