NOTICE: All buyers bidding and other persons attending this sale agree that they have read and have full knowledge of these terms and agree to be bound thereby.
ONLINE BIDDING
The Auctioneer sells as agent for the Vendor and as such is not responsible for any default by Vendor or Purchaser. Pre-Bids placed will be executed by the auctioneer; however, Auctioneer shall not be liable for any claims or costs arising from its failure to do so. Pre-Bids placed on lots passed or not sold due to reasons under the Auctioneer's control will be automatically deemed null and void. Any system-generated email messages or purchases added to an online account can be updated at any time to reflect a change. Pro-forma invoices are subject to change.
The Auctioneer may offer lots to internet bidders using its online service; however, Auctioneer shall not be liable for any claims or costs arising from its failure to do so. Inaccuracies in the catalog or on the internet will under no circumstances relieve the Purchaser from responsibilities accepted on the Bidder Registration form.
In the event of problems resulting from online or webcast auction software malfunctions, internet connection disruptions, or other computer-related malfunctions, Auctioneer reserves the right to cancel any sale. Auctioneer, at its sole discretion, may reopen bidding to determine the highest bidder. Auctioneer's decision shall be final and absolute. The record of sale kept by Auctioneer will be taken as final in the event of any dispute.
BUYER'S PREMIUM — TIERED INTERNET PREMIUM
A Buyer's Premium will be added to all successful bids as follows:
10% on the first $50,000 of the final bid price
3% on any amount exceeding $50,000
Examples:
$25,000 bid = $2,500 Buyer's Premium
$50,000 bid = $5,000 Buyer's Premium
$75,000 bid = $5,750 Buyer's Premium
$100,000 bid = $6,500 Buyer's Premium
$200,000 bid = $9,500 Buyer's Premium
PAYMENT TERMS
Payment is due within three (3) business days of auction close. No onsite payments will be accepted at pickup.

SALES TAX
Sales tax of will be added to the invoice total. If you are tax exempt, you must submit a completed Nebraska Resale or Exempt Sale Certificate (Form 13) prior to the close of auction.
INSPECTION
Inspection is available by appointment only. Call 531-215-2900 to schedule. Buyers are strongly encouraged to inspect all equipment prior to bidding.
CONDITION OF ITEMS SOLD
All items are sold AS IS, WHERE IS, WITH ALL FAULTS. The Auctioneer is not responsible for any incorrect description, genuineness, authenticity, or defects in any lot and makes no warranty in connection therewith. No sale will be set aside or allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted. Descriptions are provided as a guide only. Buyers are responsible for verifying condition prior to bidding. All sales are final.
TITLES
No titles will be given on the day of sale. Auctioneer does not guarantee titles on any vehicle unless noted in the catalog. Auctioneer reserves up to 30 business days to deliver titles. In the event Auctioneer is unable to provide listed paperwork within 30 days, buyer may return the item at their own expense and receive a refund of the purchase price and any administrative fees.
If a vehicle, truck, and/or trailer is clearly marked "No Title," a title will not be provided. Printed titles and/or Certificates of Origin will not be guaranteed on construction equipment (e.g., backhoes, loaders, compressors, etc.). Buyers of all construction equipment, other than vehicles, will receive a receipt of purchase.
LOCATION & REMOVAL
Equipment is located at seller premises across Nebraska and Iowa. Each lot listing includes the city and ZIP code to assist with freight calculations. Buyers are responsible for arranging and paying for all transportation.
All purchases must be removed no later than Friday, May 14, 2026 at 4:00 PM CST. Items not removed by this deadline are subject to a $25 per item, per day storage fee. No lot may be removed during the sale. Purchases will be released only upon presentation of a paid invoice. Auctioneer shall not be responsible for goods not removed within the time allowed or for stolen or damaged lots after sale. Buyer is responsible for all removal and loading of purchased equipment.
There is no loading dock onsite.
INJURY AND DAMAGE
Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or their agent, and agrees to hold Heartland Machinery Auctions LLC harmless from any personal injury to themselves or their agents and any property damage incurred on auction premises. All children under 18 are the sole responsibility of the accompanying adult. Buyer releases Heartland Machinery Auctions LLC and the Seller(s) from any and all liability connected with the removal, transportation, and future use of purchased equipment.
Auctioneer reserves the right to refuse any applicant the privilege of bidding and to revoke such privileges at any time.
AGENCY
The Auctioneer acts as agent only and is not responsible for the acts of its consignors or principals.
DISPUTE BETWEEN BIDDERS
If any dispute arises between two or more bidders, the Auctioneer may decide the matter or reopen the lot for bidding. The Auctioneer's decision shall be final and absolute. At knockdown, the equipment or vehicle becomes the sole responsibility of the new purchaser.
RECORDS
The record of sale kept by the Auctioneer and bookkeeper will be taken as final in the event of any dispute.
ADDITIONAL TERMS
