PAC reserves the right to reject a bid from any bidder. The highest bidder, acknowledged by the Auctioneer, will be the purchaser. The Auctioneer shall have sole and final discretion as to the disposition of any dispute including the re-offer and resale of any article in dispute. PAC records will be deemed conclusive in all respect in the event there is any dispute after the sale. GUARANTEE. All property offered for sale is as is, where is. ALL SALES ARE FINAL. PAC will have no obligation, i.e., no refunds or returns will be accepted. FIREARMS LAWS. PAC only deals in lawful transactions. All post - 1898 firearms must be sold and purchased in compliance with state and federal law. Purchasers of post - 1898 firearms must provide a copy of a Federal Firearms License or pass a mandated 4473 BGC. Due to Colorado Passing the 3 day waiting period plus a myriad of gun control legislation PAC will no longer be performing back ground checks at our 43 S. Main Street Location. FFL pickups and shipping will still occur at our location . DMG Arms will be performing the BCG's at 37 S. Main Street Longmont CO 80501. Cost will be $75 flat rate for one gun or more. Background checks must be submitted By Saturday following the auction. Due to storage issues items left over 7 days post auction will incur a $5 per day storage fee. Please understand we have zero control over the actions of our state government and be kind enough to NOT take your frustrations out on our staff or Mike with DMG. PAC makes no warranties or representations whatsoever and no employee or consultant of PAC has the authority to do otherwise, concerning the operation of firing condition, fitness for use, safety to store, or reliability, of any firearm, ammunition, or parts. Use of any firearm or ammunition purchased from PAC is entirely at the user's risk. PAC strongly recommends that all weapons, ammunition, etc. purchased at auction be examined by a competent gunsmith. PAC expressly disclaims any liability whatsoever for accident, injury or damage resulting to any person from the storage or subsequent use of any such lot. SHIPPING AMMO. We cannot ship to PO boxes. No ammunition shipments to AK/HI/P.R./V.I. CT: We require state issued pistol permit, long gun certificate, or ammunition certificate AND driver's license faxed or scanned and emailed to us and on file BEFORE we can ship. IL: No ammunition shipments to the City of Chicago. All other areas in IL require FOID faxed or scanned and emailed to us and on file BEFORE we can ship. NJ: We require firearms/ammunition ID card faxed or scanned and emailed to use on file BEFORE ordering. NY: We can ship to companies in NY registered as a FFL. We will need a copy of their FFL on file. We cannot ship to New York City proper or Five Boroughs. Washington DC: No shipping. ***Ammunition will be shipped UPS with adult signature required. Be sure to track your package. We do not ship to any other area within the United States where we are prohibited by federal, state, or local laws to ship product. You also understand that if I attempt to have product shipped to these restricted areas, your order will be cancelled and you will be subject to paying a 10% cancellation fee. LIMITATION OF LIABILITY. EXCEPT AS EXPRESSLY PROVIDED ABOVE, ALL PROPERTY IS SOLD AS IS. NEITHER PACIFIC AUCTION COMPANIES NOR THE CONSIGNOR MAKE ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, AS TO THE TITLE, MERCHANTABILITY, FITNESS OR CONDITION OF THE PROPERTY OR AS TO THE CORRECTNESS OF DESCRIPTION, GENUINENESS OF ANY ITEM. ALL FIREARMS AND AMMUNITION ARE SOLD AS COLLECTOR LOTS ONLY. FITNESS TO FIRE OR OTHERWISE DISCHARGE THE ARM OR AMMUNITION IS EXPRESSLY DENIED BY PACIFIC AUCTION COMPANIES. A COMPETENT GUNSMITH SHOULD BE CONSULTED BEFORE ATTEMPTING TO USE OR FIRE ANY FIREARM OR AMMUNITION. THE PURCHASER EXPRESSLY ACKNOWLEDGES AND AGREES THAT IN NO EVENT SHALL PACIFIC AUCTION COMPANIES BE LIABLE FOR ANY DAMAGES INCLUDING WITHOUT LIMITATION ANY COMPENSATORY, INCIDENTAL OR CONSEQUENTIAL DAMAGES. Any legal action must be filed in Colorado. ALL ITEMS MUST BE REMOVED BY THE PICK UP DATE SPECIFIED. ITEMS NOT REMOVED BY DATE PROVIDED WILL BE FORFEITED WITH OUT ANY REFUND. PAC WILL NOT STORE OR HAUL YOUR ITEMS WITHOUT PRIOR ARRANGEMENTS. STORAGE FEE'S WILL APPLY & BE ON A CASE BY CASE BASIS. Winning Bidders are solely responsible for removal of all items.
