CASTLELAND MANAGEMENT LLC – BIDDER TERMS AND CONDITIONS OF SALE By registering and bidding in this auction, the bidder agrees to be bound by all terms and conditions stated herein. Registration and bidding activity constitute a legally binding contract between the bidder and Castleland Management LLC. PAYMENT TERMS All invoices must be paid by credit or debit card. The card on file will be automatically charged 24 hours after the close of the auction unless prior arrangements have been approved by Castleland Management LLC. An 18% buyer’s premium will be added to the final hammer price unless otherwise stated. No items will be removed until invoices are paid in full and funds have cleared. Any declined, disputed, or reversed payments may be subject to additional processing attempts, administrative fees, collection actions, legal action, and/or permanent banning from future auctions. By registering and bidding, the bidder agrees not to initiate chargebacks or payment disputes without first contacting Castleland Management LLC. BIDDING TERMS All bids are binding. No bid retractions or cancellations are permitted except at the sole discretion of the auctioneer. If identical maximum bids are placed, priority will be given to the earliest bid in accordance with Proxibid’s bidding system. Bid increments are determined solely by the auctioneer. This auction utilizes a soft-close format. If a bid is placed within the final moments of a lot closing, bidding may be extended. Castleland Management LLC is not responsible for missed bids, system errors, internet failures, platform malfunctions, or bidding mistakes made by the bidder. The auctioneer reserves the right to pause, extend, reopen, modify, or cancel any portion of the auction in the event of technical issues, disputes, clerical errors, or for any reason deemed necessary by the auctioneer. RESERVE AUCTION / LOT MODIFICATION Unless explicitly stated otherwise, this auction is conducted with reserve. The auctioneer reserves the right to add, remove, withdraw, split, combine, or modify any lot at any time prior to the fall of the hammer. Some items may be sold subject to seller confirmation. This auction may include items from multiple consignors, including inventory owned by Castleland Management LLC. The auctioneer is not required to identify ownership of specific lots. The auctioneer may place bids on behalf of the seller in accordance with applicable law. AS-IS / INSPECTION / DISCLAIMERS All items are sold AS IS, WHERE IS with no warranties or guarantees, express or implied. All sales are final. It is the bidder’s sole responsibility to inspect items and determine condition, authenticity, age, value, manufacturer, model, completeness, functionality, quality, and suitability before bidding. Descriptions, photographs, titles, categories, measurements, counts, model numbers, serial numbers, and all other catalog information are provided as a courtesy only. They are believed to be accurate, but they are not guaranteed. Catalog descriptions represent the auctioneer’s opinion only and shall not be considered a warranty, guarantee, representation of fact, or substitute for the bidder’s own inspection. Bidders must rely solely on their own inspection, judgment, research, and due diligence when placing bids. The bidder’s own inspection is the only guarantee. Castleland Management LLC is not liable for mislabeling, incorrect descriptions, incorrect categories, incorrect counts, inaccurate measurements, missing information, typographical errors, cataloging errors, photo errors, omissions, accidental misrepresentations, or differences between the catalog description and the actual item. No verbal or written statement made by Castleland Management LLC, its staff, agents, representatives, or consignors shall be considered a warranty or guarantee. If an item is lost or damaged before removal, or if a material cataloging error is acknowledged by Castleland Management LLC before the item leaves the removal location, the buyer’s sole remedy shall be a refund of the purchase price paid for that specific lot. No additional damages, costs, claims, or compensation will be owed. TITLE AND RISK OF LOSS Title to all items remains with the auctioneer and/or seller until full payment has been received and cleared. Risk of loss transfers to the buyer upon removal of the item or upon expiration of the designated pickup period, whichever occurs first. REMOVAL / ABANDONED PROPERTY All purchases must be removed within the designated pickup timeframe. Failure to remove items during the scheduled pickup period may result in labor fees of $15 per hour per staff member and/or applicable storage fees. Items not removed within the scheduled timeframe will be considered abandoned and may be resold, donated, or disposed of at the auctioneer’s discretion with no refund to the buyer. Once items leave the premises or the pickup window has expired, no claims, refunds, returns, or chargebacks will be accepted. SHIPPING TERMS Shipping is available only on designated items and is handled at the discretion of the auctioneer. The auctioneer reserves the right to determine carrier, packaging method, insurance coverage, and whether an item is suitable for shipping. FIREARMS AND AMMUNITION TERMS Castleland Management LLC is a Federal Firearms Licensee. License Number: 4-34-155-01-8L-09283. All firearm and ammunition sales are subject to federal, state, and local laws. It is the buyer’s responsibility to ensure compliance before bidding. Local Pickup: For local pickup of firearms, Castleland Management LLC will complete all required ATF paperwork and conduct the required background check at no additional charge. Shipping Requirements: All modern firearms being shipped must be shipped to a licensed Federal Firearms License holder. The buyer must provide the receiving FFL’s name, address, phone number, and license information before shipment. The buyer must provide FFL information within 10 calendar days of invoice payment. If the buyer does not provide the required FFL information within 10 calendar days, the firearm will be considered abandoned and may be resold, donated, disposed of, or otherwise forfeited with no refund. Firearm Shipping Rates: Rifles/Shotguns under 48 inches: $65 per firearm Rifles/Shotguns over 48 inches: $90 per firearm Pistols: $40 per firearm These rates are per firearm and do not include transfer fees charged by the receiving FFL. Additional fees may apply for ammunition. Castleland Management LLC will not ship ammunition to California, New York, Illinois, Connecticut, Massachusetts, the District of Columbia, or New Jersey. Any order with a shipping address in one of these jurisdictions may be canceled or held at Castleland Management LLC’s sole discretion. Transfer Requirements: The receiving FFL will complete ATF Form 4473 and conduct a NICS background check. The receiving dealer has sole discretion over approval or denial. No firearm will be transferred to any prohibited person. If a firearm transfer is denied, refused, delayed, or cannot be completed for any reason, including legal ineligibility, failure to communicate, or failure to comply with transfer requirements, no refund will be issued. If a background check returns as delayed, Castleland Management LLC cannot control how long the delay will take. If the delay is not resolved while the buyer is present, the buyer may need to leave and return once Castleland Management LLC receives a proceed response or once the applicable Brady Law waiting period has passed. Buyers must meet all minimum age requirements and comply with all applicable laws. Federal minimum age is 21 for handguns and 18 for rifles and shotguns. State and local laws may impose additional restrictions. If purchasing multiple pistols, the receiving FFL may be required to file applicable multiple-sale forms and may impose holding periods or waiting times according to federal, state, or local law. Compliance with all such requirements is the buyer’s responsibility. DEFAULT / NON-PAYMENT Failure to pay for any invoice constitutes a breach of contract. If a bidder fails to pay, Castleland Management LLC reserves the right to charge the bidder’s card on file, resell the item or items, hold the bidder liable for any deficiency, assess a restocking fee of up to 25%, pursue legal action and/or collections, and ban the bidder from future auctions. No surplus from resale will be returned to the bidder. LIABILITY AND INDEMNIFICATION All persons attending preview, pickup, or entering auction premises do so at their own risk. Auction locations may contain hazards, including but not limited to uneven surfaces, stairs, tools, equipment, vehicles, debris, or other dangerous conditions. By participating in the auction, bidders agree to release, indemnify, and hold harmless Castleland Management LLC, its employees, agents, representatives, and consignors from any claims, damages, injuries, losses, or liabilities arising from participation in the auction, attendance at preview or pickup, removal of items, or use of purchased items. Bidders are responsible for their own actions and for the actions of any representatives, movers, helpers, guests, or agents acting on their behalf. COMMUNICATION CONSENT By registering to bid, the bidder consents to receive auction-related communications by email, phone, or text message from Castleland Management LLC. Contact information will not be sold or distributed. The bidder may opt out of marketing communications at any time. AUCTION TIMING AND MODIFICATIONS All auction times are listed in Eastern Time. Castleland Management LLC reserves the right to modify the auction schedule at any time, including but not limited to changing the start time, closing time, closing date, or pickup schedule for any lot or for the entire auction. The auctioneer may pause, suspend, delay, extend, reopen, or modify the auction at any point, including after bidding has begun or during the closing process, for any reason deemed necessary by the auctioneer. In the event of such modification, the auctioneer may resume the auction at a later time and may postpone the closing of any remaining lots to a new time or date without prior notice. All decisions made by the auctioneer regarding auction timing, bidding, disputes, enforcement of terms, and scheduling are final and binding.
