David J Meares LLC (DJM LLC) has put forth reasonable effort in preparing the catalog(s) used to depict Items listed for each auction to provide reasonably accurate descriptions of all Items. All Items are sold ‘as-is’ and it is Bidder’s responsibility to determine the exact condition or authenticity of each item. DJM LLC’s description of the Item(s) represents DJM LLC’s best effort to describe the Item(s) based on our opinion and inspection of the Item(s) and/or otherwise made available to DJM LLC. Bidder acknowledges and agrees that gross omissions regarding the functionality or authenticity of Items, failures to cite major missing parts and/or restrictions regarding usage or other inaccuracies may occur. ABSOLUTELY NO REFUNDS OR EXCHANGES WILL BE OFFERED, BIDDER is participating in the auction, bidding on and/or purchasing the Item(s) at its own risk. 2. FOR ONLINE BIDDING: There is a 15% Buyer's Premium added to your total purchase. 3. All accounts must be settled at the conclusion of the auction. We accept major credit cards ONLY through ATG Pay. NO CHECKS or CASH FROM ONLINE BIDDERS! 4. We are now using Shipping Saint to try and help reduce some shipping charges by our shipping providers. You should receive an invoice from Shipping Saint for your Shipping cost and preferences. As in our Shipping Terms, we are now using New Cabela's Plastic Hard Cases to ship Long Guns in and will charge $30 per Case, plus our normal handling fee and the fee charge by UPS or USPS. Shipping will be handled by David J Meares LLC - For Firearms, please email your FFL information to us at davidjmearesllc@gmail.com to expedite shipping of your firearms. All other items will ship as quickly as possible by UPS or USPS. PICKUP is available during days and times posted only! 5. If you win an item in the auction, you will be notified by email at the conclusion of the auction or the next business day. The invoice you receive on the day of the auction will be used for billing. 6. In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to ensure good communication between David J Meares LLC and the bidder throughout any transactions. 7. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month is added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Greenville County, South Carolina. 8. The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name a bidder as the purchaser. 9. The auction company shall not be held responsible for any 'missed' bids or bids unseen by the auctioneer. Shipping, when necessary, will be handled by DJM LLC. DJM LLC will attempt to ship all Items as quickly as possible by UPS or USPS; however, DJM LLC shall not be liable for any delay in shipping and delivery times. Purchasers may pick up Item(s) during days and times posted by DJM LLC. 10. All sales are final. All firearms sold are consigned items, therefore DJM LLC does not test the safety or warrant functionality of these firearms. All firearm purchases should be examined by a certified gunsmith prior to shooting. 11. By bidding on any item, the bidder shows acceptance of the terms of the auction. 12. The auction company reserves the right to refuse service or decline registration to any person. 13. Any item that is not picked up by local bidder(s) or No contact by Out of Town Buyers within 30 days will be resold and NO REFUND will be issued to the purchaser(s). The money received through the resale of the items will be used to pay storage and handling fees by the Auctioneer. 14. By signing up to bid in our auctions, you are giving David J. Meares LLC permission to add your name and email address to our Constant Contact List for future emails sent to you for our upcoming auctions. All announcements made the day of auction take precedence over any and all written, verbal or electronic statements.
