Auctioneer will invoice all items at close of sale. All payments are due within 3 business days. Any payment not received will be charged to card on file three business days after the sale concludes without written arrangement with auctioneer. Buyer's Premiums: 11% for items selling for $2500 and below, 6% for all items selling for more than $2500. An additional 2% internet platform fee will be applied to all items sold online. Should Purchaser fail to pay in full for all Auction Items) within 3 business days following the date of Sale, Purchaser shall remain fully responsible for the purchase price therefor and the buyer's fee applicable thereto. In addition to all other rights of Auctioneer contained herein, if a default occurs and Purchaser has not made full payment by the 3rd business day following the date of Sale, Auctioneer may, in its sole discretion, elect to: (a) charge a 2% late fee and, for so as long as the default continues to occur, all outstanding financial obligations shall bear interest at the interest rate of 2% per month (the "Default Interest Rate"). The Default Interest Rate shall apply from the date of the default through the time any judgment thereon is paid in full; or (b) declare any Auction Items) for which full payment has not been received a "No Sale" and charge a 20% restocking fee with respect to each such Auction Item equal to the greater of (i) 20% of the applicable sale price for the Auction Item or (ii) $250. There is a 3% processing fee for all transactions. Those paying with cash, check, wire transfer, ACH, or money order will not incur the fee. There is a $50 title fee on titled items. All buyers need to furnish all resale certificates and Texas resale exemption forms if dealers. All out of state buyers who are not dealers must furnish bills of lading from a common carrier to not be charged sales tax. All export buyers must furnish dock receipts and bills of lading to not pay sales tax. The State of Texas will issue Farm Exemption Numbers for Farm Exemption for residents of Texas. 8.25% sales tax. LOAD OUT Security will not allow the removal of purchases without a release ticket. The office will assist you with release tickets for your transportation company on the items purchased at this auction. The purchaser will be charged $25 per item, per day storage on any item that has not been removed after 10 days, plus any costs associated with relocating the items. Load out is Monday thru Friday 8-4 and on weekend days as noted. Items will be considered abandoned if they are not removed by buyer within 21 days of the auction. BUYERS RESPONSIBILITIES All descriptions are made in good faith, but it is the buyer's sole responsibility to inspect items. Items become the sole responsibility and property of the purchaser when auctioneer completes the sale of the item when the bid is accepted by the auctioneer. Possession will be obtained upon proper settlement. Purchaser will be responsible for the removal, insurance, breakdown, arranging, shifting, loading, and securing of load for any items purchased. SITE Auction Services does not arrange or contract freight for buyer's items unless agreed upon by both parties. It is the buyer's responsibility to have inspected the item and determined the condition, year, model, serial number and mileage of the item from their inspection. All persons in attendance at this auction must be an adult. No one under 18 will be allowed on auction premises without adult supervision. No minors are permitted to bid in any auction. SITE Auction Services is providing internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against SITE Auction Services or anyone else if the internet service fails to work correctly before or during the live auction. SITE Auction Services will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction concludes.
