SBOI does not guarantee that vehicles sold can be legally resold or transferred in any state or country. Buyer accepts all risks associated with vehicle title and registration laws for all states and countries. D. It is the sole responsibility of Buyer to ascertain, confirm research, inspect, and/or investigate vehicles and items and any and all Vehicle Information prior to bidding on vehicles. SBOI does not guarantee that keys are available for any vehicle sold, regardless of whether keys are present in online vehicle images, or were present in the vehicle prior to the time of purchase. E. These vehicles may not be fit for use as a means of transportation and may require substantial repairs at my expense. F. Buyers and their guests irrevocably and unconditionally waive and release their rights (if any) to recover from SBOI, its directors, officers, employees, representatives, agents, subsidiaries and affiliates any and all damages, losses, liabilities, cost or expenses and claims thereof, whether direct or indirect, known or unknown, foreseen or unforeseen, which may arrive from, or be related to, bodily injury, property damage, or other occurrence which occurs on SBOI premises. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, WILL SBOI BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOST PROFITS THAT RESULT FROM OR ARE RELATED TO THE SALE, DISTRIBUTION, USE OF, OR INABILITY TO USE, ANY VEHICLE OR ITEM, EVEN IF SBOI HAS BEEN ADVISED OF THE DAMAGES. REGISTRATION A. All buyers must be 18 years of age or older and meet all requirements imposed by the federal, state and local government laws and regulations. SBOI reserves the right, at its discretion, to deny or revoke participation for any individual or entity. B. All current and prospective buyers must possess and provide copies to SBOI of all necessary and applicable licenses. C. Buyers are responsible for all transactions and account activity, including, without limitation all bids placed by buyer and authorized bidders for buyer, either in writing, electronically, on a bid sheet, fax or email, or verbally to an SBOI authorized auction representative. D. BID PROCESS A. SBOI auction managers have a responsibility to ensure that returns are maximized, they may, at their sole discretion, negotiate with the high bidders on any vehicle, not awarded in the first stage, to facilitate an acceptable sale price. B. SBOI reserves the right to withdraw from auction any vehicle for any reason at any time at its sole and absolute discretion. C. Should a tie bid occur, each party will be solicited for a follow-up bid or bids to determine the highest bid. D. All bids, once submitted to SBOI, in either the first or second stage may not be retracted, deleted or cancelled. Run & Drive Verification: At the time the vehicle arrived at SOLD BUY OFFER INC Auction's facility, SOLD BUY OFFER INC Auction verified that the vehicle (i) started, (ii) could be put into gear, and (iii) was capable of moving forward under its own power. There is no guarantee, representation, or warranty that the vehicle is in roadworthy condition or can be driven lawfully upon the highways of any state. There is no guarantee, representation, or warranty that the vehicle will (i) start, (ii) drive, or (iii) move forward under its own power at the time the vehicle is picked up at SOLD BUY OFFER INC Auction's facility. It is the bidder’s sole responsibility to ascertain, confirm, research, inspect, and/or investigate the vehicle prior to bidding on it. Once the vehicle is removed from SOLD BUY OFFER INC Auction's premises, the buyer accepts the vehicle "as is". By bidding on this vehicle, you are entering into a legal bidding contract enforceable by the State of Indiana, Lake County Courts and agree to the following: Only bid on this vehicle if you are going to complete the transaction. Vehicle nonpayment may result in legal action against the nonpaying bidder. Nonpaying bidder pays all legal and attorney fees. All unpaid vehicles will receive a $45 daily storage fee after seven days after auction. If more time is needed it is up to our discretion to extend the pick up time without charging storage fees. The vehicle will have more miles than listed due to moving the vehicle. If the car is not picked up or fully paid for within in two weeks, we have the right to resell your vehicle and the nonpaying buyer will forfeit all deposits, pay all storage fees, a $400 re-listing fee, initial and future adverting expenses, and any associated costs with selling the vehicle and collecting the unpaid portion of debt. Local sales tax will be charged on all items in the auction unless you are exempt from paying the sales tax. You must prove your exemption to us upon registering for the auction. Non-Residents are NOT exempt on Equipment and Miscellaneous items. Branded Titles: Confiscated/Impound vehicles may be branded Rebuilt because of State law. Therefore all vehicles sold will have REBUILT brands. All vehicles with rebuilt titles may or may not have actual miles and will be sold as not actual mileage. Odometer readings are marked on the inventory tag of each vehicle. The letter following the odometer reading represents whether the miles are actual, over 100,000 or unknown, i.e., A=Actual, NA=Not Actual O=Over, UNK=Unknown or Discrepancy. Vehicles marked EX are 10 years old or older and are exempt from disclosure rules and will be sold as EXEMPT miles Delayed titles (marked D/T on the windshield/tag of the unit) will be available by the Friday following the auction. However, in some cases, it may take up to 30 days. If there is a problem with the title or it cannot be produced in the aforementioned time frame, you will be allowed to return the vehicle. The auction sale price plus the auctions fees and taxes paid to SOLD BUY OFFER INC Auction will be refunded only. DO NOT spend any money on or re-sell the vehicle until you have a title in hand. Any money spent on the vehicle outside of SOLD BUY OFFER INC Auction will NOT be refunded. Titles are processed in accordance with the Local BMV. Rules from state to state may differ and may require further processing by the buyer. Units that do not require titles in one state may have such requirements in other states. The Auctioneer /Owner is not responsible, and may not be able to in some cases provide documentation required by other states. Despite our efforts to avoid withdrawal of items from the auction after they have been advertised, it may become necessary to do so; therefore, the owner and/or auctioneer reserves the right to withdraw units at any time. Seller and/or Auctioneer reserve the right to reject a Bidder’s registration application and/or bids for any reason in their sole discretion without prior contact to the Bidder. Auctioneer cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that they are taking part in the auction electronically and the nature of the auction relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any unit(s) that may have been affected by any malfunction.
