Registration to bid in this auction will be taken as acceptance of these Terms and Conditions of Sale by the bidder. BUYER'S PREMIUM AND PAYMENT: All lots are subject to a 15% buyer's premium regardless of payment or bidding method. State and local sales tax of 6.75% will be charged to bidders residing in Ohio unless valid tax exemption information is provided at the time of registration. Any out-of-state bidders may be responsible to report purchases and pay use tax under their own state law. All bidding will be in and must be paid in U.S. Dollars. Invoices will be emailed within 24 hours of the auction's close and will be automatically billed to purchaser's credit card on file unless alternate arrangements are made prior to the end of the auction. If payment is not made within ten (10) calendar days of sale, Belhorn Auctions, LLC reserves the right to void the sale and deny future participation in future auctions. All payments must be made prior to any property being removed from our offices. We reserve the right to hold all goods until payment has cleared. Any disputes that may arise in connection with the auction and/or any auction purchase, and all of the terms and conditions set forth herein above, shall be governed by and construed in accordance with Michigan law. Anyone who participates in the auction and/or makes auction purchases agrees to submit to the jurisdiction of the courts of the State of Michigan with respect to any dispute arising in connection with the auction and/or any auction purchases. In the event that Peter D. Gehres and/or Belhorn Auctions, LLC needs to bring an action to enforce the terms and conditions herein and/or to collect any sum due and owing to it Peter D. Gehres and/or Belhorn Auctions, LLC shall be entitled in addition to collect its reasonable attorney's fees, collection agency fees, and cost of suit. MISCELLANEOUS: If any provision of portion of these Terms and Conditions of Sale shall be deemed unlawful, void, or unenforceable under applicable law, that provision or portion shall be stricken and severed from the remaining provisions, which shall remain in full force and effect. Failure to enforce any of the provisions in these Terms and Conditions of Sale shall not be deemed a waiver of the right to enforce any other provisions of these Terms and Conditions of Sale.
