All property is sold "as-is" and it is the bidder's responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Absolutely NO refunds will be offered. 5. This auction is being conducted under appropriate State and Local laws and the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced prior to the auction. Bidding on any item indicates acceptance of these terms and conditions. 6. Registration: When you go to the auction catalog, simply click on the "Register" button at the top of the page. It may take a few minutes to register, so allow yourself some time before the auction begins to complete the process. Conduct of Sale: All deposits, bids, and credits in this sale will be made in United States Dollars. You agree not to use any hardware, software, program, or system that would interfere with the orderly conduct of this sale. Closing: The Auctioneer's online auctions are designed to mimic traditional "live" actions. For this reason, this auction will have a staggered, dynamic closing. a. Staggered Closing: This online auction will automatically begin to close at a rate of one item per minute, every minute. Items' closing times may be extended past their scheduled closing time, however, as a result of the Auctioneer's dynamic closing feature. b. Dynamic Closing: The closing time of an item is automatically extended an additional two minutes whenever a bid is placed within the two minutes leading up to an item's scheduled closing time. 11. If you win an item in the auction you will be notified by email at the close of the auction. Scofield Auctions, Inc. will calculate your shipping costs based on your registration information, and send an invoice including all charges and fees. 12. All accounts must be settled within ten business days. 13. Chargebacks Prohibited: You agree that you will accept all charges placed on the credit card associated with your account, and you agree that you will not charge back any amount that the Auctioneer charges to your credit card. You agree that this provision applies equally to amounts charged in connection with any items you have won and any costs or fees discussed in Paragraph 11 of these Terms and Conditions. 14. Shipping & Handling - All items will be shipped by Scofield Auctions, Inc. via the US Postal Service Priority Mail Flat Rate boxes. An additional $5 handling charge will be added to each invoice. 15. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Carroll County, New Hampshire. 16. All sales are final. 17. By bidding on any item, the bidder shows acceptance of the terms of the auction. 18. The auction company reserves the right to refuse service or decline registration to any person. 19. The Auctioneer reserves the right to withdraw any item before the sale. 20. The Auctioneer reserves the right to postpone the auction. No one may have recourse as a result of any postponement.
