Clayton Auction Co. has put forth every effort in preparing the catalog(s) to accurately describe each item. Printed or verbal statements made by staff are matters of opinion, and are made in good faith. All items are sold As Is, Where Is, and No Returns allowed. Buyers are responsible for conducting their own inspection during open house/inspection periods, and no allowance will be made for inadvertent errors in cataloging, authenticity, or imperfections not specifically noted. It is in your best interest as the buyer to conduct your own inspection prior to bidding. A failure to do so is part of your responsibility as an online buyer and Clayton Auction Co. will not be held liable for any imperfections you might find upon delivery of your item. All sales are final ~ a bid is a legally binding contract between purchaser and Clayton Auction Co. The auction company reserves the right to reject any and all bids for any reason. Clayton Auction Co. will not be held responsible in the event of any type of internet/computer malfunction while an auction is in progress. Buyer Premium: The buyers premium is 10% on the first $3,500 and an additional 1% on any amount remaining. Winning bidders will received an emailed invoice from the auction company within 24 hrs. of the end of auction. All accounts must be settled within 72 hrs. Wire Transfers are the preferred payment method. Checks will be accepted if delivered within the 72 hr. timeframe. Credit cards are also accepted with a 3% fee added to all credit card purchases. SHIPPING: If your purchases need to be shipped, please use discretion in size and weight. All sales are final, and your purchase is NOT subject to shipping costs. We encourage buyers to pick up items purchased at the specified pick-up time(s) Monday-Friday 8a-5p. All packing and shipping costs are the Responsibility of the Buyer. Clayton Auction Co. will assist free of charge in loading. If payment is not received within the 72 hr. window the buyer will forfeit their rights to bid at Clayton Auction Co. in the future and will be turned over to Equipment Facts to assure the bidder cannot participate in other future auctions. All bidders must provide their name, address, daytime phone number, and email address at which they can be contacted, to insure adequate communication between Clayton Auction Co., and their purchasers throughout any transaction. General Information: The auctioneer has the sole discretion to advance and/or reject any bids, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in any bidding disputes, and has final authority to name a bidder as the final purchaser. The auctioneer or auction company shall not be held responsible for any 'missed' or unseen bids. Clayton Auction Co. reserves the right to alter this agreement at any time. This will take place by updating this site. Please check back and review auction terms often, as every time you use this site you are agreeing to the terms as they are written at that time. Clayton Auction Co. reserves the right to refuse service to any person, or to cancel any auction at any time for any reason. The purchaser agrees to pay all reasonable attorney fees and costs incurred by Clayton Auction Co. in the collection of funds owed. The purchaser also agrees that a fee of 2% per month be added to any unpaid balance due the auction company, as well as any other costs or losses incurred due to the purchasers failure to adhere to these terms. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. 2. When using the web site, bidders must obey any and all local state and federal laws. Violations will result in termination of web site use privileges. 3. Auction company employees and/or auction company may bid on auction items. 4. Item descriptions and photographs are not to be used in lieu of personal inspection of any item. ALL SALES ARE FINAL. 5.
