Global Terms:
Larry Otten Auctioneers LLC, herein referred to as Auctioneer is conducting auctions on behalf of the property's seller. By placing a bid on auctioneers online selling site or in person, the buyer is agreeing to all terms and conditions stated hence forth or posted onsite or online. Auctioneer reserves it's right to revise terms and conditions at any time.
TERMS OF SALE:
* Everything will be sold "as-is, where is, with all it's faults known or unknown".
* There is no warranty offered, expressed or implied.
* Buyer shall rely entirely on their own inspection and information.
* The bidder is responsible for knowing which item he/she is bidding on. If unsure, do not bid.
* Any information provided for item is done to the best of our knowledge and may not be 100% accurate and thus not responsible for any inaccuracies.
* Whether bidding online or in a live auction, auction company is NOT responsible for any lot disappearances prior to pickup, as always we try to prevent any theft.
* Once a bidder places the winning bid and auctioneer/online software says sold, that bidder is solely responsible for proper payment of lot(s) won, and keeping track of the lot. Auctioneer not responsible for any lot disapearances.
* Occasionally a lot will have to meet a minimum reserved price in order to sell.
* The winning bidder has effected a contract and is expected to pay for items according to winning bid placed, regardless or any unexpected computer or clerical error after that point.
* Any online credit card payment declined or onsite payment not made when due, auctioneer may at its discretion resell to another bidder at any time. Payments must be made when due.
* The Auctioneer reserves right to refuse a bid card and/or reject bids not in best interest of the seller.
* The Auctioneer reserves the right to remove an item from an auction either live or online at anytime and for any reason.
* Absentee bids accepted, a valid VISA/MC/DSVR/AMX must be given to be honored.
* Any invoice with a balance still owed after 5 business days following the auction is subject to penalty fees, and the maximum late fees allowed by the state of Texas.
* Auctioneers or owners make no warranties or guarantees as to genuineness, authenticity of, or defect in any lot and will not be held responsible for advertising discrepancies or inaccuracies. All sales are final, when awarded to the successful bidder. Buyer accepts full responsibility for all purchases made and holds the Auctioneer, owners, and property owners free of any liability in the event of theft or disappearances of any items purchased or consigned. Auctioneers is not responsible for any liability or damages occurred or associated with during or after the auction.
- Surplus Open Boxes : We consider these boxes have been opened and therefore unsure exactly what is inside. We will occasionally note a lot with for those bidding online only and cannot come inspect the box during our preview times that we ourselves are unsure about it and we are not responsible for the contents included or not included in the lot. Buyer beware as they say.
* All Children under the age of 18 are not advised, must be accompanied by a parent or guardian and supervised at all times.
* Smoking is not allowed in auction yard.
BUYER REGISTRATION:
* There is no charge to register.
* You must register for each auction to receive a bidder number.
* Online registration require a valid debit / credit card for a payment method.
* Buyers names are to remain confidential.
* Auction company reserves the right to require a cash / credit card deposit if it believes it is in their best interest.
BIDDING IN AN ONLINE AUCTION:

Once you are registered and have a User Name & Password, you can place bids once a lot opens for online bidding. The bids you place are FINAL and are a binding contract. Be aware that lots will close at different times and even different days and can be extended. You are responsible for monitoring these times. Bid early.
Bids can not be retracted and are a binding contract between the Bidder and Auctioneer / Seller. Bidder is accountable to be informed about property and associated costs before bidding. A maximum bid can be placed on the property. A maximum bid is confidential, and the Bidder authorizes the Auctioneer to place bids on his / her behalf up to the amount of the maximum bid. Upon the sale of such property, information and purchase amount maybe posted for a period of time. All questions or disputes must be resolved immediately; No changes or Adjustments will be made at a later date. The Auctioneer reserves the right to reopen the bidding. An Auctioneer's decisions is final.
ONSITE PAYMENTS:
* All payments are in US funds.
* All payments are due by 5pm the following Tuesday.
* Local Texas Sales Tax : 8.25% - Sales tax applied to invoice total and Buyer's Transaction Fee.
* Buyer agrees to pay all applicable sales tax on all purchases, unless the buyer provides proof of exemption that is issued by the appropriate Local or State Government Agency. Buyers must meet exemption requirements of the state or local Government Agency at the location in which the auction is held. Buyer also agrees to pay any sales tax that may be assessed after any payment has been received.
* Payment Options: Visa, MasterCard, Discover, American Express, Wire Transfer, Debit Card and Cash.
* Wire transfers and ACH are FREE.
* Debit / Credit Cards maybe accepted up to $3,000 with a 3% convenience fee when the card is swiped in person, with all sales final and no sale shall be invalidated. No refunds and credit card payments cannot be reversed.
* Please allow up to 15 minutes after an item has sold in live onsite auction, to pay for it.
ONLINE PAYMENTS:
* All payments are in US funds
* All payments are due by 5pm the following Tuesday.
* Local Texas Sales Tax : 8.25% - Sales tax applied to invoice total and Buyer's Transaction Fee, including Internet Premium.
* Buyer agrees to pay all applicable sales tax on all purchases, unless the buyer provides proof of exemption that is issued by the appropriate Local or State Government Agency. Buyers must meet exemption requirements of the state or local Government Agency at the location in which the auction is held. Buyer also agrees to pay any sales tax that may be assessed after any payment has been received.
* Payment Options: Visa, MasterCard, Discover, American Express, Wire Transfer, Debit Card and Cash.
* Wire transfers and ACH are FREE.
* Online Debit / Credit Cards maybe accepted up to $3,000 with a 3% convenience closing fee with all sales final and no sale shall be invalidated. No refunds and credit card payments cannot be reversed.
* The credit card used for the method of payment on your Proxibid account when registering for this auction will be charged at conclusion of auction.
ONSITE BUYER'S TRANSACTION FEE:
* A fee will be charged on all lots sold.
10% on each lot.
ONLINE BIDDING BUYER'S TRANSACTION FEE:
* A 13% fee on each lot
TITLED ITEMS:
* Texas Buyers agree to pay 6.25% Texas State Sales tax unless a current TX GDN holder, $55.00 Title fee, and new Texas Registration fees.
* Non-Texas Buyers agree to pay $55.00 Title fee.
* Titles / Registration to be mailed to the purchaser within 15-20 business days after proper settlement.
* No titles will be provided if items says "No Title".
* All titles are in buyers invoiced name, changes need to be made prior to full payment, No open titles will be given.
* A current driver's license and proof of insurance required to drive away.
PICKUP / SHIPPING:
* Buyer is ultimately responsible to pick up or arrange for shipping.
* Buyer is solely responsible for all cost incurred to remove items won.
* Local or Onsite Bidders -pick up their items won by Friday at 5:00 PM following the auction.
* Out of Town Bidders -pick up or ship out their items won by the 2nd Friday at 5:00 PM following the sale.

* A $25.00 per lot, per day storage fee will be due on items not picked up in time allowed, Buyer is responsible for contacting auction representatives and making other arrangements to pickup their items won if they think they will need additional time, we are happy to work with those needing shipping.
* NO items allowed to leave Auction site until all fees are paid in full.
* Buyer must present a PAID invoice before items can be removed. A $10 fee per invoice number will need to be paid by a buyer before a copy will be printed or emailed. Buyer is responsible for keeping track of their paid invoice.
* NO items allowed to leave Auction site until a Live Auction concludes or permission has been given.
* After 30 total days, items not picked up will be resold per TX state laws.
SHIPPING:
* Buyer is solely responsible for all cost incurred to remove items won.
* We can help to arrange to ship small items via USPS or UPS to addresses in the USA ( lower 48 states only), please tell us your preference or we will choose the least expensive for you.
* We can help arrange to ship larger items via LTL Freight to addresses in the USA ( lower 48 states only), please tell us your preference or we will choose the least expensive for you.
* We will need to know: residential or commercial address, loading dock or forklift available to unload.
* The shipping charges will be billed separately afterwards.
* There is a $5 administrative fee per box to ship via USPS/UPS.
* There is a $25 administrative fee per lot to arrange for shipping via all other freight methods.
* There is a $5 fee per pallet for us to provide for shipping.
* There is a $5 fee per pallet to strap when needed to ship safely.
* There is a $5 fee per pallet to shrink-wrap when needed to ship safely.
* If items need to be packaged for shipping; buyer and seller will negotiate seller's compensation.
* Pickup is Free.
OUR LOADING / UNLOADING POLICY:
* Auctioneer is not responsible for loading or unloading equipment or the securing of any loads.
* Auctioneer is not responsible for verifying that equipment being transported to/from the auction yard is properly secured or being carried in compliance with applicable transportation laws and regulations.
* Auctioneer will not load and/or unload self-propelled equipment under any circumstances.
* At its own discretion, Auctioneer. may (under the direction of the driver) help load and/or unload stationary equipment from a truck, trailer or container, when a loader or forklift is required.
* Loading and unloading of equipment is only permitted during daylight hours.
* Access to and from the auction yard is only permitted through the designated truck entrance.
* Auctioneer will not provide delivery receipts; however, if confirmation of delivery is required, Auctioneer can sign a bill of lading to confirm receipt only.
RISK OF INJURY:
Bidder acknowledges that an auction site is a potentially dangerous place and shall be deemed to be there at his/her own risk. No person shall have any claim against the Auctioneer, owners, their agents, employees or principals for any injuries sustained or for damages to or loss of property which may occur from any cause what so ever. Bringing children is not advised and must be monitored by an adult.
